CBS/Paramount sues to stop Axanar

can you ask for details of the copyright claim made to Facebook (who made it, exactly what they were claiming, when they made it and with respect to what content), i.e. get their action documentable in court, and then submit that to L&L? Granted, it might make you a callable witness at the trial. But hey, maybe you want a seat there. Seek legal counsel first.

Oh it was already made plain to me:

Essentially, this is their new form of cyber-bullying and censorship and is, frankly, the diametric opposite of Alec's self-lauded "transparency."

The best part of that reason for taking down your Post, Karzak, was the first bit:

"...because we received a report from a third party that the content infringes their copyrights(s)."

:guffaw:  :guffaw:

It was worth the coffee all over my iPad screen! :bolian:

I see that Axanar's writing staff has mastered the fine art of random unrelated dialogue.

That's the same statement word-for-word that was released the night Abrams made his big announcement. I do believe it's a standard canned statement legal gave the PR guys and said, "Just read this if anyone asks about the Axanar law suit."
Not so. The May 20 statement was, "We're pleased to confirm we are in settlement discussions and are also working on a set of fan film guidelines."

The new statement is patently different:
"Talks are ongoing. We continue to be hopeful that we will reach a settlement shortly."

What has changed is the context of the statement. The statement follows the wide reporting in the media, especially this week's articles in the L.A. Times and the Wall St. Journal, that imply somehow that what Abrams and Lin did made no difference and the studios are relentlessly pursuing Axanar regardless. Not to mention that any ability (and, possibly, desire) the studios may have had to unilaterally withdraw the case was foreclosed by Axanar's countersuit.

The intent of the studios' latest statement is to make clear that what Abrams actually promised — the eventual "going away" of the lawsuit within weeks, not the widely misreported 'dropping' of the case — is still what they're working toward.

Also, the new statement ascribes a "hopeful" element in the current status of negotiations that wasn't present in the original statement, combined with the "shortly" time element missing from the May 20 statement. These may seem minor to you, but when corporations issue statements about litigation after months of silence, every word means something.

Finally, any word of the fan film guidelines — a prominent part of the studios' first statement — is notably missing, which may confirm the suspicions many of us had that such guidelines for the broader fan film community were not really on the table for a settlement to be reached with Axanar, despite Alec Peters' hamhanded attempt to corral true fan productions into supporting his negotiating position in a lawsuit, an effort that utterly failed.

If the trailer is being removed on grounds it infringes on copyright, maybe someone could ask CBS or Paramount if the trailer should be removed or if it can stay online, since they own Star Trek? Surely they should be making decisions on what is removed from the internet if it infringes copyright...

As availability for the trailer shifts, I'll try to keep the related AxaMonitor article updated with a link to the video.

Soooooo.....more "PEW! PEW! PEW! SPLOSION!".

Still not seeing how this is "true" Star Trek, or "what the fans really want". So far I haven't seen anything other than space combat, and we've had that in the last five or so Trek films. But "Prelude" has been out for some time now, and those FX are not as fresh as they were the first time I watched "Prelude". By themselves, they're starting to bore me. Too bad they dicked around for two years and don't have jack shit filmed other than more FX. Given Peters shitaculuar acting and an only recently completed script.....why was Paramount supposed to be scared of Axanar again? I mean they were giving the impression that this film would be coming out about the same time as Beyond and it would be so good that it would make Beyond look bad.

So has Alec Peters changed his mind again about acting? I thought he was going to cast someone else for the role on account of the fact that he can't act?

Original Video - To download click on link which will open in a new tab, then right click on video and select "Save video as".

Here is the new version of the trailer without Alec Peters and excessive shouting.

Ok. I've only paid vaguely attention to this affair but I do remember one thing claimed on behalf of this "fan film"--it would be of sufficiently high quality to rival the real thing. This is what they consider a "threat" to the real thing?

Excuse me, what does Garth need with a Copyright?
I didn't know it was possible to copyright property belonging to someone else.

I think, technically, everything Axanar created, like the dialogue, would by copyrighted and belong to them. Just like all the non original IP belongs to CBS and Paramount.

It would be why CBS couldn't just take Axanar and release it without Peters permission. He would hold a copyright over certain things.

But @jespah can correct me if I'm wrong.

I would love to read a full account of everything from Christian (though I think it's good he's restraining himself for the moment in light of the suit being ongoing).
