That's the same statement word-for-word that was released the night Abrams made his big announcement. I do believe it's a standard canned statement legal gave the PR guys and said, "Just read this if anyone asks about the Axanar law suit."
Not so. The May 20 statement was, "We're pleased to confirm we are in settlement discussions and are also working on a set of fan film guidelines."
The new statement is patently different:
"Talks are ongoing. We continue to be hopeful that we will reach a settlement shortly."
What has changed is the context of the statement. The statement follows the wide reporting in the media, especially this week's articles in the
L.A. Times and the
Wall St. Journal, that imply somehow that what Abrams and Lin did made no difference and the studios are relentlessly pursuing Axanar regardless. Not to mention that any ability (and, possibly, desire) the studios may have had to unilaterally withdraw the case was
foreclosed by Axanar's countersuit.
The intent of the studios' latest statement is to make clear that what Abrams actually promised — the eventual "going away" of the lawsuit within weeks, not the widely misreported 'dropping' of the case — is still what they're working toward.
Also, the new statement ascribes a "hopeful" element in the current status of negotiations that wasn't present in the original statement, combined with the "shortly" time element missing from the May 20 statement. These may seem minor to you, but when corporations issue statements about litigation after months of silence, every word means something.
Finally, any word of the fan film guidelines — a prominent part of the studios' first statement — is notably missing, which may confirm the suspicions many of us had that such guidelines for the broader fan film community were not really on the table for a settlement to be reached with Axanar, despite Alec Peters'
hamhanded attempt to corral true fan productions into supporting his negotiating position in a lawsuit, an effort that
utterly failed.
