CBS/Paramount sues to stop Axanar

What's the latest on settling the case? The last thing I saw was JJ saying the lawsuit would soon go away.
The defense was up against a hard-date to file their Answer to the Complaint. They filed that on the Monday after JJ made his Friday-night announcement. As part of their Answer, the defense filed a Counter-Claim. In doing so, they made it legally impossible for the Plaintiff to simply drop the case because they first have to answer the counter-suit. Beyond that, I presume the settlement talks continue, but I also expect the room got a bit chilly.

Actually, that's not quite accurate. IF a settlement is reached - C/P would drop their lawsuit ; AND Axanar would drop their counter claim - and that would be that. (IE There would be no need for C/P to respond as the counter claim would also 'go away'.)

the fact that there has been no announcement of a settlement means (supposedly) such talks are continuing, but neither side has gotten a 'deal' they like yet. There's also the Alec Peters "I'm a Star Trek Fan" video (that anyone who attended the 'Star Trek: beyond' event where JJ Abrams made the 'lawsuit will be going away' announcement could make by walking into a booth set up for just that) - that was on the official ST:B Facebook page UNTIL (I assume) Paramount was notified that in the video Alec Peters said one of the reasons he loved Star Trek was because JJ Abrams announced the lawsuit was being dropped (which was NOT what JJ Abrams actually said - but how Alec Peters and many in the mainstream media spun the announcement); taken down/removed from the site; probably because it did in fact mis-characterize what was ACTUALLY said by Mr. Abrams.

So, here we are a couple of weeks after JJ Abrams said the lawsuit would be 'going away in a couple of weeks'; yet the lawsuit still exists. Hmmmm. I wonder which side is holding out?:shrug: :whistle:;)
 
Why are we even talking about JJTrek? There's a whole forum where this argument is going on. Just like with every Star Trek before it, there's a division among the fans. Let's agree to disagree and move on.

Because on TrekBBS JJ Trek is the equivalent of Godwin's Law. All threads lead to pro vs. anti-JJ Trek. It's only a matter of time.
 
I take it that if we get to Wednesday without a settlement agreement being reached, the announcement of any named Does will be on PACER?

Plus, if others are named, would there be future announcements of any details of their hiring of their own lawyers?

I hope they get their own lawyers. I hope some have been talking to some already.

Yes, any amendments (and the addition of any 'Does' would qualify) should appear on Pacer. As to details about the lawyers they hired; said lawyers would file their own responses as to the fact they are now representing a named client - and would provide their name and law firm that they are with so the court knows where to mail any correspondence. The Lawyers could even ask for a separate trial for a given defendant; but unless there are real extenuating circumstances, it's doubtful such a request would be grated as courts try to keep their own costs down; and a trial costs the government a lot of money/time.

The lawsuit certainly is going away eventually but not especially soon and not especially clean.

Okay, so first, Jespah: You got some of the coffee?!!!!! How cool is 'that'! AND HISTORIC! And -whaddaya call it--- oh yeah, Evidence!!! And sooo reminds me of in the way back when *I* was still a donor/supporter posting 'They (the production company) just 'have' to take this coffee thing down from their website if this isn't licensed properly because it's making them (production) look bad.' Lol Which eventually led me to SM Oliva's site where I began to identify some beginning points for researching my own answers to questions of what the heck that I was starting to have around that time.

If you're following this thread, Mr. Oliva, I sure do miss ya and hope all is going well for you. You know, after the credible threat that caused you to remove yourself from here, the lawsuit, and your wonderful site covering it from existence and all.

I wish I had thought quickly enough in the way back to get me some of the evidence historic coffee memorabilia too. Lol

Well, yes and no. The thing is, for the entire week after JJ Abrams made his announcement, people all over the 'Web were asking why hadn't CBS/Paramount dropped it yet.

Be. Cause. They. Can't.

Because of the counter-suit, they are forced to go to the next phase: settlement talks. You are correct in that during these talks, both sides could agree to drop the case and walk away. But CBS/Paramount can't simply drop it as JJ implied.
 
It's the vocal part that matters. There are media sources who've reported that the fans hate the JJ movies, and that the fans are into fan films instead, and that Axanar fits the fan film mold. That's why the idea that CBS and Paramount are suing the fans gained so much traction that even Lin and Abrams fell for it.

Axanar appears to be starting from scratch in developing software to ship its languishing perks
Why do they need to "develop" any code at all for this? And it sounds like Terry McIntosh wrote proprietary code for the database -- why?? I'm not a database expert, but I do know there are several off-the-shelf programs that would have fit their needs.

I would also challenge Mr. McIntosh's claim that he owns the database. He may own the server and the code, but I would have to say the collected data belongs to the Axanar project, which he is no longer a part of.

As someone who has to deal with computer security on a daily basis, I have to wonder what sort of controls and protections he has put on his servers. I presume that the collected data includes donor's screen-name, real name, mailing address, and possibly credit-card information. Given their track record thus far, I would not want my personally identifiable information (PII) in that database.
