I told you there was a REAL possibility that Alec Peters ego would derail any real settlement chance; if he assumed the JJ Abram's/Justin Lin's 'influence' meant he could ask for whatever he wanted. Seems that's exactly what happened. Also, I have to say, the 'Defense Response' doesn't cast the W&S law firm in a good light as it honestly reads:
"We still deny EVERYTHING and because we STILL believe 'Star Trek' isn't copyrightable and don't believe C/P had cause to bring the lawsuit, they should pay all our legal fees too. (BTW JJ Abrams and Justin Lin like us and agree with us.)"
There's a professional way to conduct a response to a lawsuit; W&S really don't demonstrate that as they really seem to assume the Judge doesn't know or understand copyright law. IF CBS/Paramount decide not to settle; you can be sure the Judge and a Jury will be 'schooling Axanar, Alec Peters and the Winston and Strawn legal team come January 2017.

So, somehow Erin Ranahan psychically discerned JJ Abrams beforehand? I can guarantee that response was rewritten furiously over the weekend to take advantage of JJ's comments; but if they go too far (and they might have here), I have a feeling both JJ Abrams and Justin Lin will be getting e-mails form C/P saying - "You know when we told you guys we'd work out a settlement with Axanar? Well, after that response, um, no..."Abrams's statement was made Friday; this document was filed with the court yesterday. Do you really think that Alec was personally responsible for anything that appears in the response? I'd imagine that everything therein entirely reflects the best legal judgment of the lawyers rather than any outbreak of ego on his part.

Although I am sure @jespah will have her expert take on the Answer, in my layman's view this feels like more of the same "Throw stuff at the wall and see what sticks" - the Defense denies everything, attempts to reuse arguments from the MTD, names a dozen or more affirmative defenses, contradicts several of those defenses, spends a few pages praising the fanvenance of Alec, and then flips a bird at the Plaintiffs by countersuing. Along the way it makes some unintentionally funny assertions, like those little curlicues on the Space Elf robes were Chinese, not Vulcan, and that CBS/P have abandoned their copyrights.
Oh and it still pretends that Paramount and CBS haven't clearly provided enough evidence of who owes what copyright.
It's the best Ranahan can do, and it won't hold up very well in the light of day.
