CBS/Paramount sues to stop Axanar

And this is where I think this production went farther and is different from all other fan films. This production states it wants to appear as if "it came from the studios", it wants to be " the beginning of a whole new way fans can get what they want" without dumping "hundreds or thousands of dollars a year" on cable channels. Which would have a significant commercial impact on the studios, and would be accomplished by using their own Intellectual Property to make this happen.

"commercial impact of the infringing use, which the Supreme Court ruled “is the single most important element of fair use”

Oh yes, the most quotable remark of all. Speaks loads to intent. Crowdfunded programs sold over Amazon, Netflix, and Hulu.

Someone with their own money and their own content will do it.

If Axanar Productions had had any brains, they would have used the experience of doing a totally legit super fan film to go after patents for that business model, rather than lusting after physical assets and salary and fame.

Or Ares Digital, which is now in place for delivering all-new digital content. I am of the opinion that this is the end reason Ares Digital was conceived and implemented. To eventually enter the digital streaming market, using it to market what is spoken of here: "beginning of a whole new way that fans can get the content they want, by funding it themselves." To this end I feel that this is an equivocal statement: "Why dump hundreds or thousands of dollars a year on 400 cable channels, when what you really want is a few good sci-fi shows? Hollywood is changing. Netflix, Hulu, Amazon, and other providers are redefining content delivery, and AxanarProductions/Ares Studios hopes to be part of that movement.” With the endgame plan being Ares Digital to 'be' that part of the movement.

I ripped a copy of this interview to keep, just in case Loeb & Loeb want it. Fuck this guy.
 
Just another point about how little Alec knows about public relations... this dipshit spends the entire interview slouching back in his seat, his right hand constantly rubbing his temple, his bug-eyed gaze occasionally wandering as he (tries) to spin his story. No wonder Mike Bawden wants to "clarify" all of Alec's comments! :lol:

This isn't about that! This is about how you basically ripped off a shitload of fans to make a movie you didn't fucking make and instead paid yourself and your ex-girlfriend a goddamn salary.

Truly dazzled to see he would use a laptop camera pointing upwards into his face, when he is fighting the impression that he looks down on everyone. But he seems completely oblivious to the personality he is projecting. Maybe its because that creative fraction of a percent he described they are in (podcast 31) should be judged solely on the stories they tell about the quality they say they produce off camera.

It was my understanding that this was all Axanar, headed by Terry. At least, their statements to this point give that distinct impression (I believe it was in the first Axanar thread, where Terry was answering questions).

What cracked me up was Alec going on about "the fans." The fans are okay with all of this, the fans love me, the fans are kept informed, the fans, the fans, the fans. As though that's a perfectly legitimate excuse for Alec has done.

It's like saying I went next door stealing my neighbors mechanics tools, slept at a Holiday Inn last night and attended a convention funded with a stolen credit card, and my gold fish loves me. Because I have fans, I'm special, and screw anyone questioning me. :lol:
 
Maybe the new Trek TV show should just show up and throw him out, asserting that these assets belong to the production company with the most Trek fans.
 
You know, interviewers and columnists really should start calling Alec out aggressively on this "Axanar is the voice of the fans" justification. Which fans are we talking about, Axanar fans? 10000? out of how many hundreds of millions who go to Trek movies worldwide? STID did about 470million$ worldwide. suppose the average ticket price is skewed to USA but cheaper in some places, lets say 50 million tickets. I know someone posted numbers on this thread recently. then 500,000 = 1%, 5,000 = 0.01%, 10,000 = 0.02%, one fiftieth of a percent, one in 5 thousand. One seat for each 10 full IMAX theaters of Trek fans.

He is grounding his validity in claiming he speaks for 'the fans'. Trim him back down to 'the Axanar fans', interjecting "one fiftieth of one percent of those who pay for movie tickets".

"So to summarize for those vested in the Axanar project, you say that you speak for the one fiftieth of one percent of Star Trek fans who paid to see Axanar done, one seat out of every 10 full IMAX theaters of fans, and these numbers are an overwhelming mandate justifying your business actions, overruling the CBS copyright rights, and demanding the rescue of Trek; and you are here to be their standard-bearer as long as you get a studio and salary out of it".​

Wait for the "well I am sure that for every person who donated, there are 100 who feel the same way", or trying to distinguish movie goers from fans. Pin him back to: nonetheless the only actual expressed support is from this very, very small proportion of fans who have paid for your product.

No doubt an argument would arise that his fans should include youtube views. This is a much more nebulous number than those who are willing to pay, it is much more prone to overcounting uniques; comparison of who pays on each side is a more accurate analysis.

It certainly doesn't matter who at Axanar sees these ideas tossed about; they know certainly that the number of useful days they can get out of claiming the speak for "the fans" has an expiration date.

Great Interview, I think that this YouTube channel deserves a lot more likes and subscribers then it currently receives.

Burnett didn't like having his bullshit quoted, and tried to flame me both on Facebook and Twitter accusing me of, get this ... theft! :D
