I wouldn't put it past any of them though to try and erase/get rid of as much as possible in the meantime though, no matter the penalty...........

Which is why I wonder about the hosting change. If you drop your ISP that hosts your emails, you may accelerate the day when your email becomes unrecoverable. I don't know if their email was hosted on their former ISP but if anyone received an email from axanar at a domain axanar owned for business purposes, it is likely very possible to track the host company down. Unless they were using anonymous email service.

I'm guessing that anything C/P would want to go after would be contained in private emails/IM-Chat logs between those in the inner circle.........Lord Alec, RMB and Terry might be dumb, but from what I've seen, they're at least smart enough to keep anything blatantly incriminating off of their public-facing pages (at least on their website/Facebook page)

Oh it does occasionally come up, then a few minutes later gets deleted, but there are 30 odd podcast still up with a lot of incriminating comment made by RMB and Alec.

If you want to get a taste of how AP and his director characterize trolls, go find the axanar podcast 31 on libsyn and start listening about minute 35 more or less. it takes a while to build, but what they say will get your attention. If you can stick it out you can also hear some sexist idiocy and a big personal dis of a TOS star before it all ends.

In fact if you haven't listened to the whole thing, its worth it to become crystal clear about these guys.
 
Off to buy extra popcorn, because an international law firm that has 850 attorneys, does pro bono work as a matter of course and made $820 million in 2015 has the deep pockets to go the distance, if their intent is to set some new precedent.

But the law simply doesn't seem to be on their side here. Plus, if CBS loses, then you can figure every major IP owner will be part of the appeal behind the scenes.

But, why would CBS/Paramount put two guys on a stand to say a meeting didn't happen? That wouldn't be good for THEM. It would show that Peters wasn't warned to stop, that he was violating copyright. If anything it would bolster his "But, I didn't know" defense.

Alec acquired most of his collection 2006-2009, when the Christies and It's a Wrap sales were held. Because there were sales every week of costumes and props, the average resale prices for the things purchased have risen. Something he paid 600 for, he is now asking 2,000, etc.

Did CBS themselves ever say this meeting took place? I have only ever seen their statement about not endorsing the project.

The Statute of Limitations for fraud in the great state of California is three years. But if the matter goes into bankruptcy (personal, corporate, or both), then the donors will not be secured creditors (which the secret consortium set to buy up the Valencia leasehold might become).

News flash: secured creditors often get priority in bankruptcy proceedings.

Spoiler alert: if there is $1,000,000 in bankruptcy debts, and only $500,000 available to pay everyone, and the secured creditors hold $600,000 in debts (which they can prove in a bankruptcy court), then there will be nothing left for anyone else.

Donors - don't want this to happen? Then you might want to consider acting sooner rather than later, because this IP infringement case is not about you.

This might be the only financial recourse as well, assuming the donor is unable to talk Axanar Productions into a refund. I was looking casually at credit card chargeback time limits (so I am unfamiliar with the intricacies and there may be other options), but it looks like donors may be outside of the window: https://oag.ca.gov/consumers/general/credit_cards.

Okay RMB......for all the good intentions behind that statement, you're still working with 1st grade logic....

-His description about Axanar & the Custodianship of the 'Star Trek Franchise' is classic fanboy delusion......possibly mixed with some of his Jameson too - no one aside from his acolytes is going to take him seriously. C/P own the copyrights, they make the films, they have 'custodianship' of the franchise, plain and simple.




-Alec's point about reverance for the source material and giving fans what they want, I will concede that I do understand where he's coming from...........there are alot of fans out there who love the original series films, who grew up with them and remember the era with a healthy dose of nostalgia. That era is gone - I don't know how clear I can make that point. Further, indulging the nostalgia of a group of fans is definitely no excuse...........(and again, I'll point to Phase II, Continues etc to underline this point)

-Now where he talks about the 'trolls' being 'twenty seven percenters' who want something for nothing are just out to tear you down.........this whole bit is where his narcissism and self-delusion really get put on display. I'm not even going to validate that BS, because we've all been refuting it for the last 3 months and 600-odd forum pages here.

-Also, in the last 600-odd forum pages, the issue of facebook groups going from public to private, rampant forum censorship and Terry's blatantly unprofessional behavior have been brought up numerous times........so please RMB, don't act like you have any grounds on which to talk about 'civil discourse'.............

Of course. But then they would put that evidence before the court. Not two guys who didn't meet with Peters so they could prove he lied to the donors, like you pointed out.

What he said to the donors only matters so far as proving their case of infringement. All other lies don't mean so much.

How can any of this exist if the movie doesn't even have a completed script? This all seems to exist in some form that can be shown, according to this blog on the Axanar web page.

Correct. This notion that the lawsuit was "unripe" and "restricting future speech" is just legal posturing on the part of the AP defense team. Every single bit of public comment indicated that Axanar is ready to film, and filming was delayed so that the production team could get a larger nozzle on the money hose.
And filming is delayed right now because lawsuit.

so then can this happen? Ax Prod sells sound stage to consortium for half a million, consortium declares bankruptcy before paying off, AP has first dibs on liquidation of consortium, sound stage is valued 100k in bankruptcy, AP gets sound stage back and gets 400k writeoff?

I listened to the entire podcast, I must be a glutton for punishment. LOL. The admissions made would make Loeb & Loeb's day, I hope they listen to it. I'll add to what you've posted.

*AP & RMB both admit repeatedly they are using CBS/P's I.P.

*Alec & Co are leasing Ares Digital to other fundme projects (supposedly at cost) foreseeing the income generated as a means to fully finance Ares Studios.

*They are licensing their own Axanar brand merchandise.

*Alec supposedly approached CBS asking if they would favorably recognize Axanar perks as official Star Trek merchandise.

There's a lot more, mostly trashing fan films, CBS/P, Bad Robot, star trek forums, anyone asking questions, while living in their delusional vaccuum as Keepers of Trek. Make no mistake, after listening to that podcast it's clear AP & RMB are setting up a rival business corporation based on stealing I.P. financed with donor money. The entire podcast is a tortuously long foot bullet.
