CBS/Paramount sues to stop Axanar

By W&S's interpretation, "Star Trek" is not copyright-able because both "star" and "trek" are common words in the English language...

I think maybe people take the CBS statement to be a confirmation of Peters' claim. Ain't necessarily so.

You just need to reverse the order of the quotes (e.g., reinsert the context AP stripped out his quote) to see the tap dance on donor's heads:

CBS says, “CBS has not authorized, sanctioned or licensed this project in any way, and this has been communicated to those involved...We continue to object to professional commercial ventures trading off our property rights and are considering further options to protect these rights.”

Alec says, "The big news is a meeting with CBS I had. While I can’t discuss details, I can say that it was good to finally find out what CBS thinks of us. There will be a lot more discussion I am sure, but the CBS’ desire NOT to give any guidelines was discussed as well as the problems that causes for Axanar. We are basically working in the dark. But both John Van Citters and Bill Burke are good people and I have known them both for a few years.
 
I'm trying not to get caught up in this, but I can't help but continue to watch the whole disastrous scenario unfold out of morbid curiosity, as one would stare at a train wreck. :wtf:

Isn't a little disingenuous to say "there is no final script" because scripts change all the time throughout shooting the film, as anyone knows, so no script is truly "final" until the film is done and done?

Sure. I think their argument is a bit more too, that there isn't any action taken on their thoughts, only the thoughts exist, and even those are not finalized, so there is no crime. This works for one person's thoughts, its established principle. But once there is a group involved, and at least one concrete step was taken towards the contemplated action (i.e. build a set for the planned film), then in criminal law conspiracy penalties can apply, if the activity is criminal, like robbing a bank. Civil, I don't know what is analogous. But W&S seems to be making the comparison.

They are going to be shoved into discovery.

They'll have the testimony from the two CBS execs who were present. I bet they'll be testifying.

I really was able to relate to the Jessup character Nicholson played. That doesn’t mean I like the character. Let’s face it, he is an arrogant ass. But his feelings for Kafee (the Tom Cruise character) are those of resentment, disgust and a lack of respect. So for me that simply meant finding those feelings and creating a bridge into this scene. And frankly, it wasn’t that tough. I had someone I felt all that about, so I had those emotions right there.

Yes. He played Jessup in an acting class. :lol:

Reading the sports news just now and something in the article about the US Women's Soccer team filing an EEOC complaint caught my eye and has changed my perception of this case.
The action was filed by the law firm of Winston & Strawn
Off to buy extra popcorn, because an international law firm that has 850 attorneys, does pro bono work as a matter of course and made $820 million in 2015 has the deep pockets to go the distance, if their intent is to set some new precedent. :lol:

Even though it was written by an abject failure at life - this is pretty good.
 
Not to mention emailed locked final scripts in the hands of any does turned witness.
Not mention RMB said they had sent out their script to a breakdown service to send it to talent agencies all over town and that CBS had a copy and said it was a great script this was on the old ISWCBS group. And that CBS had a copy of 'the script' and that was how they got it. So, either RMB was lying that CBS thought it was the greatest script, or S&W are, or they never told S&W but I suspect there is a lot they've not told S&W.
 
Either way, it isn't good for Peters. Because if CBS gets up on the stand and says that meeting never took place, then Peters is caught openly lying to his donors.

But, why would CBS/Paramount put two guys on a stand to say a meeting didn't happen? That wouldn't be good for THEM. It would show that Peters wasn't warned to stop, that he was violating copyright. If anything it would bolster his "But, I didn't know" defense.

CBS/Paramount doesn't care if Peters lied to his donors or not. Him lying to his donors doesn't matter to their case. It is inconsequential to the case. The donors who are upset need to understand that CBS/Paramount's case doesn't revolve around them and justice for them. It might work out that way in the end, but CBS/Paramount are focused on their goals.

Is it me, or is RMB putting on weight? Anyway, not sure it helps to have a Captain's Log written by people named Dim and Wit who go about listing all the Klingon (infringing) costumes and props they have.

Nice to know our suspicions that Ares "Warehouse" Studios has been serving as a Propworx storage facility are correct, that Alec despite living on minimum wage has been able to spare enough lettuce to buy props, and that enormous amounts of money are being spent so that the production team doesn't have to creatively overcome any obstacle during shooting.
