CBS/Paramount sues to stop Axanar

I do not the following, and it is a bit of a follow-up to an earlier question someone had before I had read the complaint.

"injunction restraining Defendants, their agents, servants, employees, attorneys, successors, assigns, subsidiaries, and all persons, firms, and corporations acting in concert with them, from directly or indirectly infringing the copyrights in the Star Trek Copyrighted Works, including but not limited to continuing to distribute, market, advertise, promote, produce, sell, or offer for sale the Axanar Works or any works derived or copied from the Star Trek Copyrighted Works, and from participating or assisting in any such activity whether or not it occurs in the United States"

I think the question was "does this get at the model kits?" Yes and no. It would stop them from selling them in the future, but does nothing with respect to the past sales. As far as past sales, the complaint doesn't allege that these are infringements that C/P is suing on.

Someone else asked "would this keep them from doing future fan films?" Yes, if enforced literally, as they would be prohibited from infringing any Star Trek Copyrighted Works, which any fan film based in the Star Trek world would likely implicate.

I'm sure Axanar will challenge such a broad injunction. possibly even arguing it is unconstitutional as it prohibits them from doing what everyone else seems to be permitted to do, and so is a discriminatory judgment. To which I would offer the analogy: "Look, any other guy in the world is free to ask Jane on a date. Except you, because she took out a restraining order."

And that amended complaint explains (at least to me), why Tobias wanted his account deleted/deactivated rather than just be banned. No one would have found his posts from before, e.g. regarding the Vulcan scene:

"That whole sequence was done within 3 weeks from start to finish - including building all the vulcan scenery, ships, camera tracking, rendering, compositing. Bascially 3 weeks with no social life and very few sleep for me :)

I´m glad that most of you like the outcome. Regarding the "bump" - i never would have thought that so many people noticed. I intentionally left that one in to give the whole shot a more realistic feel. If you smooth everything out, you get a very artificial look.

CBS owns United States copyrights in the Star Trek Television Series and Paramount owns the United States copyrights in the Star Trek Motion Pictures. Plaintiffs have duly registered copyrights in and to the Star Trek Television Series and Star Trek Motion Pictures with the United States Copyright Office and have complied with all applicable statutory registration and renewal requirements. The United States Copyright Office has issued Certificates of Registration for the Star Trek Television Series and Star Trek Motion Pictures that bear the numbers identified in Appendix A

Does that technically mean I can register Star Trek in the UK?

On information and belief, Defendants have filmed at least one other scene from the Axanar Motion Picture

What scene would that be?

You could try. It would be nice to have a second 600-page thread on TrekBBS regarding C/P suing somebody in addition to this one. :lol:

But, seriously - no, the reference to "United States copyrights" is just a statement proving the U.S. Federal court has jurisdiction over the case (i.e, C/P isn't trying to get in U.S. court suing on an Algerian copyright); without it, the court would have no jurisdiction to hear the case and it would be dismissed. It shouldn't be read as implying C/P doesn't have rights in these works under the copyright laws of other countries (and the U.S. is a signatory to several copyright treaties that provide for (not exactly, but in effect) reciprocal protection of each country's copyrights in the rest of the treaty countries.)
