Getting booted from Axanar FB page is almost like a badge of honor, you stood up and asked the question they couldn't answer and called you a hater or trouble maker and sent you on their way and patted each other on the back.
Wow. Of all people, I never expected Tobias Richter to be such a willfully ignorant crybaby. Disappointment, man. Disappointment. Greg could not have been more clear (here or in that FB conversation). Much like Alec Peters, Tobias just wants to fall on his sword. I say let him. He likes the closed account, but doesn't like (for his case) what the system calls such deactivations--a "ban."
I wouldn't object to a simpler and less inflammatory term "deactivated" label for these account dactivations---if that IT change can be made. "Deactivated" sounds more objective for *all* cases--and more accurate in Tobias' case.

Tobias is German, as am I (obviously). I can't explain the situation to him better than you did, Greg, as I'm not even befriended with him over at FB. He doesn't seem to have grasped the idea at first, that a "ban" would have allowed him, in the days/months/years to follow, to return whenever he would have asked, as has been pointed out.
Some day it might occur to him, that the whole heated discussion could have been avoided. I don't think, that his Trek BBS postings or history would show up in any resume he offered as a calling card. Not as of two days ago, anyway...

It appears someone a little more knowledgeable about civil proceedings is posting, so take my stuff with a grain of salt (and I've only been loosely following this). I would imagine a motion to dismiss would fail at this stage - at least by the defense under 12(b)(6) (Failure to State a Claim). At this point, all motions are in the light most favorable to the non-moving party (so, if there's any ambiguity, you assume the other side is going to win on that point). I assume Paramount has the stronger argument anyway so, if they're the non-moving party, I definitely think they'll at least survive a 12(b)(6) motion.
I suspect this case will be resolved by a Motion for Summary Judgment after all the discovery in the case is in. It might be that a lot of the facts aren't in dispute. In that case, I could see the case resolved much sooner after limited or even no discovery. But, generally, you need depositions and discovery before a case can be resolved in favor of the Plaintiff.
Does anyone know if the pleadings are posted online? I'd like to see Axanar's Answer in this case.

I don't know how one goes 'antisemitic' against a forum and I haven't seen anything that suggests Tobias has anything against Jews. This post just seems odd, as in you have a misunderstanding regarding what antisemitism is. Or are you suggesting that just because he's German, he must be antisemitic? I'm genuinely confused as to what you meant by this.
