As for "bad things being said?" Sorry, Axanar, we are NOT Axanar. People can ask question and unlike at their sites, they're NOT shut down. The price of free speech means that you sometimes get unpleasantness. Deal with it. For two million fucking dollars, you can deal with it. I put up with a helluva lot more for a helluva lot less.

I wouldn't object to a simpler and less inflammatory term "deactivated" label for these account dactivations---if that IT change can be made. "Deactivated" sounds more objective for *all* cases--and more accurate in Tobias' case.
It appears someone a little more knowledgeable about civil proceedings is posting, so take my stuff with a grain of salt (and I've only been loosely following this). I would imagine a motion to dismiss would fail at this stage - at least by the defense under 12(b)(6) (Failure to State a Claim). At this point, all motions are in the light most favorable to the non-moving party (so, if there's any ambiguity, you assume the other side is going to win on that point). I assume Paramount has the stronger argument anyway so, if they're the non-moving party, I definitely think they'll at least survive a 12(b)(6) motion.So, does this mean the Motion to Dismiss is off the table, or is this just preparation for the likelihood it will be rejected.

I don't know how one goes 'antisemitic' against a forum and I haven't seen anything that suggests Tobias has anything against Jews. This post just seems odd, as in you have a misunderstanding regarding what antisemitism is. Or are you suggesting that just because he's German, he must be antisemitic? I'm genuinely confused as to what you meant by this.
