CBS/Paramount sues to stop Axanar

The script is locked, except it isn't. They're ready to film, except they're not. People are cast, except they aren't. Peters is playing Garth, except when he's not. Peters/Axanar have cast THEMSELVES as liars, either to court or to their donars. Does it matter which? A liar is a liar.

Finally had a chance to read the response. Personally I think the most it will achieve will be to delay matter. Obviously I am not familiar with the cases they quote as they do not apply to me in my jurisdiction, but purely from the point of view of logic, litigation experience and the general approach by the courts I find the response quite weak. They are attempting to have the case dismissed either on technicality or insufficient detail. Personally I would contend that there is sufficient detail. In my jurisdiction intellectual property law takes into account the perception of the industry the infringement arrives in, along with the perception of the public at large. While I can see some merit in than asking for detail as to who owns want, overall we all know that the rights to the franchise are split between the two and since both are plaintiffs to the action I ultimately don't see that it can be argued that one or the other isn't in ownership of the elements of the ownership of the franchise IP. So, it seems to be, that once this hurdle is overcome and further clarity provide, this argument will effectively be defeated. If the IP law regime in California is anything like mine then perception is an important factor. They say that it is premature to assert that the full film is an infringement. But here's where I have an issue. You can pick apart the individual elements until the cows come how. The fact is that the combination of the various names, logos, design and so on are very clearly from the Trek franchise and the whole crowd funding strategy has been funded on the link to the franchise. The sets are based on it's hallmarks. Logos and costumes have been used. Ship designs have been used....and all this have been promoted by Peters & Co during the production of the full project. I really don't therefore see how a technical argument can succeed, because quite clearly the thing speaks for itself. The reasoanble man on the street would look at it and conclude that it is a Star Trek production.

Personally, when I read the reply and wasn't remotely convinced. So either Peters' lawyers truly think they have something special in the authorities they rely on, which I wouldn't be familiar with, or they're just giving it their best shot. I guess we'll have to wait and see.

By the way, it looks like because of other court commitments outside of this case, CBS/Paramount are looking to postpone their response to later in March, and to have the hearing on it on April 11.

The latest document just states that both sides have agreed to the continuance, but it's still up to the judge.

The latest filing is an agreement by both sides to postpone CBS/Paramount's response to the motion to dismiss or strike, that the due date for CBS/P's response be moved from Feb. 29 to March 11, that the defense rebuttal deadline move from March 7 to March 28, and the hearing itself be moved from March 21 to April 11.

I'll let Janet upload the files later ... but all of that is still left in the hands of the judge to make the final decision.

Pretty soon the Axanar people will be reassuring their donors that this whole thing is just a ploy by the studios to prevent Axanar from being released before Beyond or the new Trek series so that it doesn't drain billions from the box office and All Access subscriptions* - and that CBS/Paramount will relent and let Axanar go forward just as soon as their own product has been successfully released.


* Not, of course, that Axanar would charge for their movie - but Real Fans will have their Trek appetite so sated by the magnificience of Garth that they'll just be uninterested in studio Star Trek after that. ;)

Well, he sure did his damnedest to dox me, with all three of his puppet accounts there, using my name.

My REAL name, which again, Peters only just learned this past weekend. I guess he felt the need to try to get a rise out of me. And while I did comment on the article over there, it's a shame the insecure prick completely harassed the wrong person, assuming they were me.

Like a poor marksman, Peters keeps. missing. the. target...

More importantly, he knows better. He's known I value my privacy for years and it has, likewise, eaten him up for years that he didn't know my real name so he could bully me outside of online forums. Now that he has it, he's shouting it from the hilltops. My favorite part is where he repeatedly accuses me of being a "failed" writer in Hollywood, yet my decade in Hollywood seems to show a nearly consistent resume of work and steady progression and advancement. No, I'm not a working writer (yet), but it's also one of the hardest industries to break in to. I'd gladly hold my IMDb up to Peters for comparison any day and I'd stand by my work every time compared to his two short films and the half dozen times he's played Garth in the fan films. :lol:

Really quite sad, actually. I've reported him to both Disqus and The Hollywood Reporter, so hopefully something can be done about his ability to post there since he clearly has no respect for boundaries or personal privacy.

As I said before ... Peters is a scumbag and a psychopath. Anyone needing proof only needs to read the comments of that article.

Yeah, waiting till April 11 is going to be a killer. At least we will have the Plaintiffs answer and the Defendants rebuttal to keep us busy.
