At this point, my expectation is that anyone invited to get involved in a fan film that violates said new rules would have to look at Axanar and ask themselves "What's the worst that could happen?"![]()

I missed this the first time thru .....So Axanar is basically telling the court that, if it finds in favor of CBS and keeps them from creating their film – which they allege is noninfringing – those actions by the court will amount to a violation of their free-speech rights under the First Amendment, would result in a taking of property under the Fifth amendment, etc.
Sarcasm?!?Just read a bit about the Axanar-proposed guidelines on the open Axanar facebook page. People are intrigued and enthused by the very fair and reasonable proposal that would see fan filmmakers licence their films to CBS/Paramount, allowing the latter to make a certain amount of use of the films. With reasonable restrictions, of course; CBS and Paramount can't just use the whole thing.
Very generous of them to allow CBS/Paramount a licence, I thought. Maybe CBS and Paramount will be allowed to make their own Star Trek movies and TV shows, if the fan film producers are okay with that.

They are, in essence, saying that any copyright law is un-Constitutional because any ruling against the infringer violates their First Amendment rights.
That's what I find so distastefully odious about W&S's defense of AP. They are basically claiming AP has a legal right to be a thief.For all the jokes and sarcasm - this is one of the two core reasons I'm following this to the bitter end.
The entire idea that's came up that a trademark or copyright can be 'hijacked' because someone else thinks they have a right to it is extremely offensive and dangerous and opens doors that will cause significant damage across the board. All the focus is on fan films and studios etc - but if there was ANY movement or doors opened even a little for someone to take my branding/properties, that'd be a step towards not paying the rent.
Huge and dramatic leap from A to B - but if that defence was given any credit whatsoever, the potential for it to be expanded and abused by other parties down the line is terrifying.
