CBS/Paramount sues to stop Axanar

Note (before I dive back into wedding bloggery) - plaintiffs have 21 days to answer the counterclaim, per Rule 12 of the Federal Rules of Civil Procedure. That would be the 4th of June, which is a Saturday. I imagine it would carry over to that Monday, the 6th, but am not 100% certain.

Doe day of reckoning, June 8th, is unaffected by the answer and counterclaim, so far as I can tell.

I expect the plaintiffs to call for an accounting by a forensic accountant. Where's the #AxaMoney ?

Here's our most definitive answer regarding what happened Friday:

Nevertheless, despite these public comments, the present action remains pending, and Defendants are currently left with uncertainty as to how Axanar may proceed with its film to fulfill the wishes of thousands of fans who have contributed.

For me, here's the most interesting line in the new document. It's the last sentence of paragraph 31 on page 25: "Instead, Defendants have created an original story inspired by Star Trek, as Gene Roddenberry hoped fans would continue to do."

Others will know better than I do, but is there even an iota of truth to that claim? Roddenberry would support Peters? Maybe even throw a few bucks into his Kickstarter campaign? Really? Really?

I am dumbfounded. Only a complete idiot would warp/exploit Lin/JJ's support in this manner.

I don't care how much of an egomaniac someone may be. Having to go through a lawsuit like this should be enough of a teachable moment that you wouldn't look a gift horse in the mouth like this.

This is going to be a real litmus test for how much sympathy and leverage JJ/Lin really have to be put on the spot like this.

It's cringe inducing.

My apologies for pushing my prediction so hard that AP would exercise common sense. I was so wrong about this...

For over 900 pages, we have been watching this exact sort of thing unfolding. It is cringe-inducing. It does defy common sense.

I swear I will face palm through my skull one of these days. Sorry for the baptism by fire. This is why we binge on pie.

I tend to think that they still have to prep like they are going to trial without a settlement in hand. It doesn't look good, but I can see the logic.

Lord Alec & his brain-dead supplicants created a story inspired by (if not totally ripped from) this FASA Gaming Supplement. Given Roddenberry's distaste for the overly-militarized RPG, I highly doubt he'd endorse such blatant fan-wank like this.

I recall people saying Alec defended bidding in his own auctions by claiming it was a blind process conducted by someone else on his behalf. Criticism of this I think was that he would be paying the buyer's premium in effect to himself, thus able to bid more, and that the potential for shill bidding was created anyway. I believe these comments have been posted here in this thread some time ago.

But this discussion really goes beyond his justifications. I wonder if further info will emerge about the D7 now that this is posted in the current discussions.

His friends and workers bid up buyers. Admitted to the audience live at the Vegas convention auction in August 2015. After I asked.

Good safety tip - Don't patronize a firm that cheats its own customers.
