CBS/Paramount sues to stop Axanar

I've been directly involved in filing for both Trademarks and a Registered [Trade]Mark with the legal department at Bandai Namco (notably for the game PAC-MAN + TOURNAMENTS™), so I know something about those things. As others have stated above, the trademarks are the things you have to register and renew, and they're actually not that easy to "lose" from lack of active-defense as people online would lead you to believe.
 
I would imagine the a judge could order the injunction as soon as next week. This would mean a complete stoppage on all work, stopping the Indiegogo campaign, suspension of there website. Freezing there paypal account. Removal of videos on Youtube, and possible suspension of there Facebook accounts. Should Alec somehow win the case these things can resume. A trial is going to take at least a minimum of a couple mouths to happen (unless it is expedited somehow).

If Alec does not comply with the judges injunction order, he would be in contempt of court and face jail time.

While you're here, Tom, I have a question: did Tim Russ get paid for being a producer? There's a guy on the FB page who insists that Axanar did nothing different from Renegades.
 
The one question about Axanar I never got answered regarded a sequence where Federation ship passes by the forward section of a D6 and the D6 fires a lone torpedo - I always wanted to know why they did that when it would have been easier and better for the Klingons to fire the disrupters
 
Court cases don't usually happen that fast. Assuming this ever goes to trial (I suspect Axanar will cave and they'll settle by surrendering the farm and signing a "we'll never do it again"), it'll take months and months, if not a year. Lawyers want to have time to build a defense, which means depositions, audits, due diligence, etc. etc.

It's annoying but probably lucrative for CBS.
It's bad news for the jury, unless they're interested in the case.
It's good news for the lawyers.

As far as any Star Trek fans go...

It's bad news for the Axanar team, though based on the twitter/facebook posts you would think this is the best thing that's happened to them in months.
It's upsetting news for people who donated.
It's sad news for fans of Prelude who were looking forward to Axanar (me included).
It's probably unnerving news for producers of other fan projects and fans of those projects.


That's a small fraction of Star Trek fans. Otherwise, it doesn't directly impact any other fans at all. I'm sure those fans are real though. I haven't pricked any of them, but I'm sure they bleed as well.

Our plans are for an elaborate premiere event in a proper and state-of-the-art theater venue, and there will be private screenings in theaters during major conventions in the months after the full film has been released, but Axanar cannot be shown for-profit at a commercial theater as a commercial film would be. That would require a license from the rights holders to Star Trek and that is something that we do not possess.

Cheer up! We're getting a (what I hope to be) great Star Trek film this year, and a Star Trek series next year! That's pretty good, I say. :)
 
With some of the support Alec is receiving and the way that people are commenting on their boards I still say they should go the religion angle...

No, but he got some as an Actor per SAG rules that we had to follow. All the producers such as myself were not paid. I do this free. NOBODY on STR gets a salary, We need all the money we can to pay for goods and services strictly related to the production.

When we found out Diana is getting salary for handling fulfillment for 10,000 donors on Axanar. Myself and a a couple others that handle close to that many donors for free, and joke around about getting a raise. LOL
Ah, good, I thought so. I had mentioned that Tim didn't pay himself like Alec did, and I had my fingers crossed that I remembered correctly. Thank you for that information, and yes, if I were you I'd ask for a raise! I'd ask for double what you were making before. ;)

EDIT: By the way, I just want to say thank you to you and the folks at Renegades for putting up with those of us who were snippy towards the film, and still treating us like Star Trek fans even though our tastes were at odds. I didn't realize the difference until I saw the way Alec and co. were treating people who disagreed with them.

Seriously though, his senior staff need to jump ship, as CBS has included 20 (to be named) Doe defendants. I know, i would not want to be sued. The sushi is good, but not that good!
