To clarify, what happens if he pops it during the case? I presume there would be a short delay?

As much as I would like the good Judge to live for longer, if he does die or have a debilitating illness, wouldn't it be funny if the Clerk assigns it to a Judge Kirk

There's no Judge Kirk in that district as far as I can tell. As for a judge passing away mid-trial, I honestly don't know how that would work. Depends on the court.

It just seems like the further along this gets, the more damage he's going to do to other fan films.
 
He's got to be feverishly convincing himself that this will never go to a hearing.

The worst case scenario, as far as other fan films go, is if this gets to the Ninth Circuit on an appeal. This would most likely occur if the judge grants a preliminary injunction and Axanar appeals. Once the Ninth Circuit rules, you have potentially binding precedent on the subject of "fair use" in unlicensed productions.

Kidding aside, they simply assign a new judge. If it's a short trial, the new judge might simply review the court records/transcripts and pick up where the other one left off. If the case is too complex, the new judge may simply grant a new trial at her discretion. This varies state by state, tho.

I'm kind of confused by the whole tax exempt non-profit thing. I thought that was pretty much just churches and charities? Can a movie or movie studio actually get that?

As for the lawsuit's being about other fan films too, I would think there would have been some kind of indication that this was about more than just Alec Peters and Axanar by now if that was the case.

A tax-exempt non-profit can be any organization with a charitable, religious, educational, literary, or scientific purpose. It's actually pretty broad. A movie studio might qualify under scientific or educational, as Star Trek Continues is attempting to do.

Frankly tax-exempt/non-profit has no bearing to the case at this point. That's not what the suit alleges, furthermore. there's nothing in Copyright law that says its okay to violate Copyrights if you don't make money. I think the whole "we don't make money" thing is to try to stay off the lawyers' radars and not give them a reason to come after you in the first place. It's too late for that, now.
