CBS/Paramount sues to stop Axanar

I still think this may provoke an amendment to the guidelines, since as noted previously, its just the arms race all over again. They should require those who do crowdfunding to only accept crowdfunding except for true rich uncles giving let say 10k or more. This would prevent rollover of most prior crowdfunding to later mailing lists, and be auditable....

This is an interesting idea, in that it would presumably also, for the most part, weed out the folks who donated but who barely have two nickels to rub together. E. g. folks on fixed incomes and the like.

Going on with what Carlos and others touched on regarding the appeal for donations, there's this little gem...........(that even court docs have refuted)

Not looking to weed them out of donating to each campaign, only from being rolled over into a back-door mailing list while gathering another fresh crop from a new crowdfunding, or manipulating crowdfunding to invite 1$ "Join our mailing list" donations for a nudge-nudge wink-wink purpose.

Certainly would be interesting if the studios happened to independently notice this backdoor email use, and somehow in parallel came up with some such idea to further bulletproof real Trek from looting... and then demanded it for Axanar's conduct, to be considered compliant to the settlement 'no public donation seeking' terms... *cough*

The lawsuit forced us to invest all your remaining money into completing a rentable studio owned by us, instead of sitting tight on the money and having *something* left to make Axanar. It wasn't that the lawsuit threatened to take the money away, and we chose to shelter the cash where we could complete *our* perk from the crowdfunding and make the money untouchably accrued to us and not ever spendable for you. Nope, not that at all. You expected *us* to carry *our* studio so long as donor money was available?? ???

BTW, we need your money now to create your film perk. Smile and ante up.

How could he be 30 days away from shooting when by Alec Peters own testimony is deposition, there was no finished shooting script (even months into the lawsuit), nor were any sets finished; NOR was the studio anywhere ready (building code wise) and TO THIS DAY still isn't?

The level of retroactive BS is astounding.

It troubles me that there is a large mailing list (and mailing lists are valuable - they can be sold!) and the same folks could presumably be contacted from now until the end of time, for donations. I am not so sure most of the donors felt they were signing up for that.

Kickstarter's Terms of Service specifically prohibit the use of donor's information by or for third parties. While Peters might be able to sneak by contacting previous donors, selling the list to a third party would be a no-no.
 
I am almost tempted to join Axanar's mailing list just to see what sort of tripe gets sent out first hand.

It would add a bit of variety to the crowds of people interested in enlarging my penis or having me help them move large quantities of cash out of Nigeria.

Alec Peters already violated that (the Kickstarter TOS) when he used that mailing list to announce his most recent Propworx Auction. I mean given that he's also violated the Kickstarter TOS he agreed to when the first Axanar KS started by not giving requested refunds because the film CANNOT be delivered as promised in that Kickstarter...

Bottom line: I seriously doubt Alec Peters cares whether or not he violates any KS TOS further.
 
Size isn't everything but I noticed that only 84 people liked Slow Lanes FFF on Facebook. Take off that the obvious people like himself and the Axanar team and his reach may not be as far as he would have us believe.
