CBS/Paramount sues to stop Axanar

Hmm. Axanar website appears to be offline. I keep getting error messages.

I got an error page momentarily, but it's back up now. I can tell it's Axanar because I see Tony Todd's photo. He's gonna be in it, y'know!

I got an error page as well, but said that it was loading a historical version of the site....

Same here. It looks like the page it's loading was the December 30th version (judging by the Captain's Log blog post).
 
Given the sense of entitlement, enormous ego, and persecution complex your average Axanar donor has, they must be panicking that Anonymous is now fucking with them over this.

"Big fish, small pond" just doesn't seem to be a thing for these people. :shrug:
 
I just can't wrap my brain around the theory that somehow CBS is angling to make an offer on or somehow or other take over Axanar as its own. That's just simply delusional. Why would any full-time professional entertainment outlet consider such a thing, when they have the much simpler option of crunching this thing like a cockroach?

That and they're in a town with thousands of talented creators looking for work.

Plus, I'm not sure the broader fanbase is really clamoring for a series based on a war from the old FASA role-playing game.
 
I posted an update to my blog post from yesterday, which I'll reprint here:

UPDATE (1/5/16): Alec Peters has made public statements indicating Axanar Productions, Inc., will file for non-profit, tax-exempt status. I saw a blog post by Peters dated December 11, 2015, on the Axanar website (which is currently down for some reason):


Today was a day spent with Andrew Schmidt, Axanar productions new in-house legal counsel. Andrew has been a friend for a long time, and will be working with our legal team at Eric Feig Entertainment Law, who handles all our big legal issues. Andrew is a volunteer and will be reviewing everything we do as well as working on our 501c3 application (non-profit status) for Axanar Productions. He will be handling all paperwork and making sure we are well buttoned up.


I acknowledge my error in not double checking to see if Axanar had in fact made any statements regarding non-profit, tax-exempt status. However, this was the only mention I could find of seeking tax-exempt status on the Axanar website. Nor is there any mention of this purported application in the annual report that Peters released to the Axanar donors.


Having previously worked in the non-profit world myself, I find it rather odd Peters would not have been more forthcoming with any plans to seek 501(c)(3) status until just a few weeks ago. If I were in his position, I would have made it clear from the outset of the Axanar project–i.e., before he launched his first crowdfunding campaign–that Axanar Productions, Inc., was a “501(c)(3) in formation.” That’s an important practice, because the whole point of 501(c)(3) status is that it allows your donors to deduct any contributions to your organization from their taxable income. You have no reason to hide or play coy with the fact you’re seeking such status.


Finally, as I explained in the original post above, “the profit/non-profit distinction only matters in terms of how CBS chooses to enforce its internal policies, which in any event is not an express written license to use copyrighted works.” Whether Axanar Productions applies for and receives 501(c)(3) status–and that process could take several months, if not years–it does not alter the strength of CBS Studios and Paramount’s legal case for copyright infringement.

I got on their main page without issue and the links also seem to be working. "Click to Donate" is still there in big letters and links to IndeGoGo. :lol:
 
This happens every once in awhile with their site. Looks like its an internal issue at Axanar.

Yeah, I've seen it, It's error 522, It mean that or Time out error accord while using cloudflare. The error fault is on Axanar. Which mean, either someone is jamming them or they're getting lots of traffic.

I prefer to think that Axanar's own lawyers have stormed the place and taken control of all computers and smartphones by force. They're claiming self defense. :)
 
I just received a message from Indiegogo stating they're reviewing the Axanar campaign to verify that it complies with their terms:
