Case dismissed! Discovery and Tardigrade game "not similar"

Didn’t mean to doubt you. Just a figure of speech. But judge really should end it for his sake. Nothing good will happen for the guy if this drags on further.
 
If this doesn't look like desperation and a frivolous case, I don't know what does. Poor guy in terms of his current circumstances, but yeah, I think the judge needs to dismiss this and spare the man more pain and bitter disappointment down the road.
 
Yeah, dismiss it now and save him further legal expenses.

It would be real nice if we could somehow hold the Youtube idiot fringe accountable for this.
That sounds kind of off to me, you know dismiss the case because of costs. If he hasn't a case then that should be the reason to dismiss it.

It looks like discovery did not go well for Abdin. He’s now publically asking people to email information that will help the case

Why just a month ago he was claiming that the Judge had already ruled in his favor...

When actually, he incorrectly assumed that because the Judge allowed a period of discovery, it was a ruling in his favor toward having a legitimate case.
Obviously it didn't mean that, but as his more recent post shows, his lawyer has not yet found anything to back up the claim about someone working on the show had seen his STEAM game proposal.
I'm not really sure why he's asking for help now, since the deadline has passed for his lawyer to submit any further findings.

Having just checked the court documents, there's still no ruling from the judge either way.

Just based on that post and knowing that the limited discovery is over, his lawyers must have sat him down and told him that he was likely to lose the MTD because they didn't have enough proof.

I've always thought these lawyers expected to file the suit and then CBS would settle quickly to make it go away because they wouldn't want the bad press especially after sueing Axanar. I don't think they really expected CBS to actually fight this. However CBS did fight and now they are in trouble.

The only one really in "trouble' is Abdin's Bank Account.
It cost him $400 dollars alone just to file the original suit, never mind what all the extra filings required by the court for errors, probably added on to that.
His lawyers probably sent him the bill for the proceedings up to this point and he fainted.

I don't know this for a fact but I'd guess that, given the circumstances in how they came to represent him, Abdin's attorneys took this case on contingency, meaning they're the ones eating most of the costs in hopes for damages in a court win or some kind of settlement to which they'll be entitled to at least a third.

Ah, you're probably right.
Obviously I'm just going by my own 'armchair reading' (as in Not a Lawyer) of all of this based on what I've found on STEAM and read in the court documents on line, but it seems as if the longer this drags out the more likely it is that Abdin's lawyers are starting to realize that risk was far bigger than anticipated.

Any guesses as to why the court may be taking this length of time to make a decision?

Also, have you seen any documents that establishes that the plaintiff's lawyers were able to find any kind of link between STEAM and a DISCOVERY employee?
(beyond the one incorrect one already given)
Would something like that even be posted by the court?

According to my research, Judge Schofield is known for taking her time in issuing rulings on motions like this. I think the less important the case, the longer it takes. Which doesn't bode well for Abdin, I think. Hence his plea for help.
