Both shots say "IN THEATERS SUMMER 2009". Summer does not begin until late June. Now, sure, the movie will still be in theaters when summer comes around, but it's being released in spring.

As of a few hours ago, it wasn't (I checked somewhere around 2am PDT). It's at least listed now, but it still says "Not Yet Available" when you actually go to it.
If you do a search for Star Trek Destiny, Gods of Night says (Mass Market Paperback - Sep 30, 2008) and Mere Mortals says (Mass Market Paperback - Oct 28, 2008). There's no evidence on a Kindle version of MM that I can find, though.
