In the United States. Federal law says prior to 18 is statutory rape, federal law trumps state law. Also in 24 of the 50 states there exists "Romeo and Juliet laws" which say that if minor had sex with someone whose only a few years older, the legal penalties would be reduced.
Not all statutory rape cases are federal cases. Hell I'd say the vast majority of them aren't. And even then the federal laws aren't overly clear. This is from Wiki as I'm not at all a lawyer or looking into having sex with teenagers. However a general rule of thumb is don't have sex with a high schooler if you are out of high school.
