For anyone who believes the Arizona law is racist and all that BS, here's a perspective from someone I know, on another forum, who lives in Utah. He's in a smaller town where he works as a mortician and also volunteers with County Search and Rescue.
Can I just tell you guys some down to earth, real experience, 1st hand knowledge with this Arizona law.
Here is the problem. Illegal immigration is illegal to the Federal degree. Not the states, nor county, nor city. The feds have been tasked with controlling immigration. They have not kept up with the current situation, they are far, far behind.
In most of Arizona, as well as Utah, INS is the authority who takes custody of illegal immigrants. But they have rules. They won't just come out for any illegal immigrant. In fact if you pull over a car load of illegal immigrants and call INS, they will tell you it's not their problem. The local officer has to let them go. INS has several rules, and I will name them from the top of my head (the numbers may be off a few). INS will not take custody of an illegal immigrant unless there are more than 7 or 8 of them together, or if any one of them has commited a crime. They will take custody if the illegal immigrant has been flagged in a national database, or is being pursued by any law enforcement agency. There might be a couple other rules, but this will suffice.
So, you pull over a car load of illegal immigrants. You may charge the driver with no driver's license, but INS still won't come get them. You basically have to let them go. BUT, what Arizona has done is to make it against STATE law to be an illegal immigrant. So, now they have forced the Feds' hands in the matter. The INS agents must now come and take custody of them because they have broken a state law and are now criminals for being in the country illegally. INS has to do their job now.
It would be wonderful for Utah to follow suit. Maybe tweak the law and introduce it as a different law than of Arizona. Nothing bothers you more than having a van load of illegal immigrants speeding down the road at 3am, pulling them over, and having to let them go becaus there is NOTHING you can do about it. If you impound the van, or take them to jail for the night, then all you have done is made a huge problem in town because now we will have a large transient illegal immigrant population without ANY services to support them.
The INS is NOT doing it's job. That's why Arizona stepped up. It MAY reak of discrimination, but only because 98% of the illegal immigrants in Arizona come from south of the border.
