I just saw the new trailer! (Spoilers? Well, yes!)

and Kirk has already impressed Pike at this point by warning him in advance of the Narada's attack on Vulcan.

That doesn't mean his training is complete, thereby qualifying him to be an officer, let alone a senior officer in the chain of command.

On a ship a captain CAN grant field commissions and promotions. Starfleet command can later override this if they so chose, but I doubt they'd take any punitive measures against an action that proved a great success.

Court martials don't find officers not guilty just because they're supposed to be the bad guy. If anything putting Kirk in that position would look really bad, because it would look like he only did it because of his history with that family.

It is not a modern military organization, nor its it run strictly by humans. We don't know exactly what kinds of regulations they have, nor what leeway a captain is granted for shifting the chain of command on his ship.

S'all I'm gonna say. I could be just at nitpicky as you about a lot of things if I chose to be, but I'd rather just enjoy the movie.

Well yeah, I am exaggerating, we have not seen it get completely blown up, it just seems that the pattern of damage and explosions is the same but from different points of view... just odd that's all

The academy must not have been too pleased with Kirk if McCoy had to help him fake being sick just so he could come along for the ride.

It very strongly resembles a naval system that we would be familiar with now. Otherwise there would be no point to having there be cadets, they'd all just go right to the ships as soon as they joined. Cadets are not in the chain of command because they are still in training. If they were ever put in command, it would be as part of an exercise designed to further their training, with a qualified officer standing by to take command at a moment's notice. And if JJ Abrams is going to bash the original franchise for doing cliched and corny shit in order to justify his reboot, he really shouldn't follow it up by doing cliched and corny shit like putting someone in command of a ship just because we know he's supposed to be in the RU during that time.

Actually, at the very beginning when it was announced that JJ Abrams was making a new Star Trek movie, I was pretty excited, mostly because he didn't seem like a complete loser and because his name wasn't Berman or Braga. But as information came out about the movie, my opinion changed, and if you've noticed, I always qualify my opinion. So the usual theory of "he just hates it" that takes all of twelve brain cells to think up just doesn't describe what's happening here.

I'm being critical, yes. Nitpicking would be like noticing Data was missing a rank pip in one scene or something. I'm criticizing the implausibility of a cadet ever being placed in command of a ship, let alone one on the verge of getting kicked out.

I wouldn't call it nitpicking. I don't think we have enough facts to render judgement on the matter, but if this film is indeed about Kirk's journey from rudderless youth to commanding officer of the Enterprise, it would be nice if each of the steps in that journey were plausible.

For my part I'm more interested in whether the tale rings true for the character than whether it makes sense according to what we can imagine of Starfleet protocol and extrapolate from contemporary analogues.

And if JJ Abrams is going to bash the original franchise for doing cliched and corny shit in order to justify his reboot, he really shouldn't follow it up by doing cliched and corny shit like putting someone in command of a ship just because we know he's supposed to be in the RU during that time.

Except that nobody, to my knowledge, has ever identified "unrealistic command structure" as a serious flaw in Star Trek to date. There's nothing to fix. The lack of realism is deliberate, maintained for dramatic purposes. Starfleet protocol serves the characters as needed, not the other way around. Realism is suffered until it runs into something more important.
