News Alec Baldwin Accidentally Shoots & Kills Cinematographer, Wounds Director with Prop Gun

Well its not guaranteed yet but it seems likely, which sucks because the armorer is definitely guilty. The incompetent prosecutor (seemingly) wanting to "stick it" to a celebrity means that the woman who deserves to serve time for the death of a woman might get off with barely any punishment.

I really hope this at least means the end of the armorers career, I can't imagine even the smaller/shadier film productions are going to want to hire her, even if she gets let off on basically a technicality.
Indeed, yes. That is the frustrating part is that there was undoing of a legal process on a technicality.

now, I've been wondering if Baldwin closed that production co., or simply bankrupt it, then there is no more civil lawsuit against him, would that work?

It is a technicality, and if they go to jail for violating the rules then so be it.

The point being we did not get an actual trial because of this procedural foul up. We were not given evidence to review, for people to consider.

As for jail time, well that's up for a trial, isn't it?
 
I think Baldwin has the option to dissolve that co. Rust production (or whatever it is called) and avoid paying a penny to the other side.

What's the name of that Fox chnl. tv show that list TV actor suing or being sued, in that TV show, they show these actors, to avoid lawsuit on the co. that they own, all they need is to close that co.
 
Looks like this denial was on technical (page limit) grounds with the prosecutor already resubmitting a revised version.

I don't know enough about NM criminal procedure law to know whether this is part of preserving the record for an appeal by the prosecutor or even if the prosecutor can appeal the ruling. However, it wouldn't shock me if the trial court's ruling is/will be appealable as it appears to have been on legal/procedural, rather than purely factual, grounds.

the judge that look after Bladwin's case, is it the same judge that look after Hannah's case? because have a look at the above link that the judge Summer is looking into dimissal of Hannah's case.
 
It's my understanding that the Judge dismissed With Prejudice, meaning legally Mr. Baldwin can't be brought to trial again on the same charge...

Assuming that it's a jury trial, I believe that "double jeopardy" only attaches if the case is dismissed after the jury is impaneled.

Not sure if that makes any difference here?

I wrote this last year that this whole exercise is a waste of time, that there is case law under Brandon Lee's case, that noone is at fault

In the case of Alec Baldwin, there are too many people at the set, anyone could have mess w/ the bullet.

Then comes the fact that some bullet mysteriously turn up at the police station in the middle of these investigation is very suspicious. Police should have collected those evidence, how on earth can some John doe walk into a police station and hand over critical evidence?

then comes the key evidence is destroyed. How does the Defense team analyze the evidence when it's destroyed?
 
Only got eighteen months anyway, she's almost done a third of her sentence already.
 
My opinion is that Baldwin is guilty of manslaughter at least. He should be put in jail. The person who handed him the gun (the armorer) should be in the cell next to him. They should have checked the cylinder before it was handed to him.
Any evidence should have been documented by the police. Anyone who destroys evidence should be charged
 
The whole episode is a sad commentary on the current state of the judicial system.

The armorer is totally at fault.

Baldwin should not have pointed the gun at the team…or fired the gun… but I dont expect any Hollywood liberal elite to be able to determine a live round from a dummy round. Honestly, could any of us check a gun and know that they were live rounds? Should he bear some burden of responsibility? Yes.

Ultimately, Why no “rubber gun” as the scene did not demand it? Beats me.

1) The FBI destroyed the evidence, they should be charged. Everyone is equal under the law. I bet any $ that is a strong consideration for the judge giving that if the trial continues, how on earth can she allow a weapon that was destroyed by FBI to serve as evidence?

"W/ Prejudice" means "the state cannot bring charges against Baldwin again in Hutchins’ death"

3) the case is a train wreck from the start. Dave Hall hand Alec the gun, and said "cold gun", and Dave Hall gets probation. Who's the genius come up w/ that arrangement? Dave Hall is the one who should do 18 mth.

4) Check the cylinder makes how much difference? can they tell live round vs. dummy round? the person who brings live round is the person who really should be responsible. And that should Seth Kenney

5) in the history of USA, since the special prosecutor Kari T. Morrissey has to take the stand, you know the shit has hit the fan. For that matter, look at the history of justice system around all G20 country, and ask them if there is ever a case that the prosecutor herself has take the stand
