Something tells me that the powers that be aren't really taking LFIM and this whole mess seriously. Wouldn't surprise me if one or more of them thought that putting this shyster in his place would be more trouble than it's worth.

The guidelines were issued to the fan film community of which the LFIM acts like he's a part of. I refuse to validate the whole Axanar profit center with even a click

An effective strategy might just be to let him finish the Axanar shorts no matter how he manages it, all signs point to it being crap, which probably ends the Axaverse better than suing him to oblivion.

    From the latest donor email:
A couple things. First of all, being bad at making a profit isn't the same as being a nonprofit. Otherwise General Motors would be legally registered as a charitable foundation. Speaking of legal registration, Alec has been applying to be a non-profit since the Obama Administration! What's wrong, is 501c Application Filler-Outer another one of those vacant Ares Studios positions along with Production Accountant?

He's as efficient a paperwork-filer as he is a filmmaker.

And the Donation Desperation continues (from the latest e-mail):
No, he's not publicly fundraising for Axanar on Patreon (or LYING about his IRS tax status)...oh, wait...

Jesus, what will it take for CBS (or the FTC or IRS WRT the 'non-profit BS above) to pull the "In Breach" trigger? This is getting flagrantly ridiculous, IMO.

Ares Studios is a not-for-profit film studio that supports fan films and high school student film makers. Ares Studios is currently applying to be a 501c3 non-profit with the IRS, which will mean all donations will be tax deductible.

Wanting to be a 501c3, or even applying to be a 501c3, doesn't make you one. Applications for tax-exempt status are denied all the time. So promising donors that their donations will be tax exempt is, at best, premature, and at worst, fraudulent. Does anyone know if 501c3 status can be granted and apply retroactively? That doesn't seem like something the IRS would do...

Encouraging people to try to claim a donation as charitable and thus tax exempt when it isn't, possibly leading to someone getting into trouble with the IRS, seems like a pretty low-life thing to do. :klingon:

According to IRS publication once the application is filed it can operate as a tax-exempt, even if the status is pending:
The part I bolded indicates that donations will only become tax-deductible if the application is approved. So, it's a bit of a dice roll. Nothing new in this case though.

I suppose "from a certain point of view", they are a non-profit, because don't you have to actually put out a product before you can begin to make a profit???

if i was a corporate lawyer, i think i'd like to work for CBS. first garth vader, and now that middle-eastern guy that sues them because apparently they stole the whole Discovery premise from his video game. is it true he faked death threats against himself using his own handwriting in the process of gaining money for an appeal of the dismissal of the lawsuit? heh. mate, i used to fake stuff when i was 10 (?), but i used to alter my handwriting, use a typewriter or the neighhbor's computer printer. watch some crime show for christ's sake. i'm sure CBS All Access got you covered.
