Case dismissed! Discovery and Tardigrade game "not similar"

I told some friends not to listen to Gary and dropped them Axamonitor. I doubt it did any good. Why invest so much hate at a company that you'll believe anything against it?
Trump supporters could probably give you a few reasons as examples.
Not that any of those would be logical or intelligent though.

A side note...
It seems that YouTube is starting to shut down some of the more severe Trek ranting and conspiracy videos.
Looks like CBS is going into full swing with pointing out and asking for Copyright Strikes against several TY Trek posters.

I'm not going to watch the video, in case he gets money from views, but does he say what basis that videos are being taken done. If it's random people talking about stuff (and not using clips or videos or anything), I don't think that they can be violating any copyrights.

My understanding is that it seems to be for extended clips and such.
Many also appear to be from 3rd party claims, not only CBS itself.
 
The silence from the judge is killing me.
I guess it's not at the top of Her docket and there must be other cases keeping her pretty occupied.

I suppose that it is possible that the Judge has already ruled, but the court hasn't finished dotting the i's and crossing the t's to make the decision publicly known.

@carlosp hasn't posted any updates to the AxaMonitor FB or Twitter pages in some time and hasn't posted here since the last week of March.

Could the Judge have thrown it out?
If it was dismissed then there would be an informative session in court with both sides present.
That in turn would be released to the public record almost immediately if not within a few days.

Nothing of the sort has occurred yet to my knowledge and I've been checking the internet just about every day for any documents to have been released.

It may be a possibility, but usually once a judge makes a decision, that decision is uploaded to the case page by the judge's staff without any further action by anyone else at the court. In other words, it's pretty safe to say that a decision has not yet been made, which I doubt is unusual for this type of case.

Most of the time a case can just be dismissed and the judge's ruling uploaded to the court filing system without any type of session in court. But it may be different for bigger cases like this.
 
Well, this is just awful. Anas Abdin posted this to twitter yesterday:

I feel my life is turning dark. I'm sitting next to my unconscious father fighting for his life. I lost my job. Everything is collapsing.

So, perhaps the suit is on hold while he deals with his father's medical emergency? And I gotta say, this just makes me even angrier at his sleazy, incompetent lawyers. They're straight up taking advantage of this poor guy who isn't thinking straight because his father is dying right in front of him. Oughta be a crime.
 
Poor guy. I feel for him in terms of the unfortunate circumstances which have befallen him. However, that doesn't make me any more inclined to support his case against CBS. It really should be dismissed, considering how flimsy his claims are.

I, too, think he's been influenced by the wrong sort of people, online CBS/DSC haters who've egged him on, incompetent lawyers who should have seen the writing on the wall months ago and so on. I wonder why he also lost his job.

After 40+ years of working in the medical field, I can see where taking care of his ailing father may have become a full-time job in itself.
A lot of business here in the USA do not tolerate multiple work absences even for the most dire of circumstances and will can your butt.
In some foreign countries it's even worse.

In this particular case both sides have already submitted their final writs and everything is in the Judges hands at this point.
Nothing happening overseas would preclude the Judge from making a final determination.
(the case was started in the southern district of NY)

Yeah, for companies that aren't large enough to fall under the Family and Medical Leave Act here in the U.S., many (most?) would not allow an employee to take an extended leave like that. Even if your job is protected under the FMLA, you still aren't guaranteed any pay unless you use accrued vacation, sick, or other type of leave).

The Judge can grant an MTD without having both sides at a hearing - as long as both sides have complied and filed responses within the timeframe specified by the Judge.

Yeah, that's... not a good thing. If CBS can shut them down, they can shut down ANY review channel or anything that uses clips, regardless of how creatively they're used. It's a long-standing and widespread problem with YT - basically, they HAVE to respond immediately to any copyright strike request (which is indiscriminate and usually automated) forcing the channel to dispute it which is a lengthy process where any revenue for the period is lost.

No matter how terrible these channels are, they have the same right as anyone else to include clips of the show in the context of their commentary and shouldn't be shut down for that reason. The reason they thrive is because they work - they consistently get promoted to the recommended section. The only good way to combat them is to tweak the algorithm to better differentiate between gaming the system and quality content - easier said than done.
