Case dismissed! Discovery and Tardigrade game "not similar"

What I mean is, I do not believe that it is in CBS's interest to settle the Abdin case in order to avoid going to trial.
If they can get what they consider to be a favorable settlement, then of course they should take it. But if it's not, then, no they really have a lot to lose by giving Abdin even a pittance
Because you think it will encourage others to file actions similar to Abdin's, right? But ask yourself what losing a case like this at trial would say to people? It would say that "you can win even with a weak case like this".

If the case is not dismissed, there is certainly at least a chance it will end up in trial. I have been trying to explain to you that that "chance" is where the settlement value is for CBS.
They may have spoken out of turn without knowing the particulars of the case (like the weak level of sympathy Trek fandom had for Alec, despite supporting the idea of fanfilms being able to be made without being sued) but from a PR perspective CBS/Paramount kind of had to limit things to a slap on the wrist.
Yes, this is pretty much what I thought was going on. I doubt CBS had any intention of taking the case to trial unless Peters forced them to. What they wanted was to assert their copyright ownership and all of the associated rights.

Having Peters admit copyright infringement let the fans know that no matter how we may feel about CBS, they were within their rights in filing the lawsuit. Last thing they wanted was to make it look like big bad CBS was destroying this "little" Trek fan. Very bad optics.

The two cases are only tangentially related. The infringement of Alec Peters was indisputable. The infringement of CBS/Paramount on Abdin is more coincidental and speculative (closer to most music cases like Stairway, Blurred Lines).

While it's true that small fry will often mount frivolous lawsuits like this as a simple cash-grab, plagiarism can and does happen and there should be a system in place to deal with it. It's far too easy to steal ideas and laugh all the way to the bank. I mean, Ib Melchoir claimed to the end he came up with the concept for both Star Trek and Lost in Space. What may be legally actionable (or winnable) and what's fair are often two different things.
 
It does very much appear though, that Abdin 'borrowed' several aspects of design from ENTERPRISE.

While going over his stuff again this morning I remembered that there was another pic that he had included with his original designs that he has since apparently removed and I couldn't put my finger on what it reminded me of till recently...
I remember that one of his female characters was wearing an outfit very similar to to what Leila had on in "This Side of Paradise".

But I can't find that particular drawing of his now...

A video popped up on my YouTube feed suggesting that CBS admitted ripping off The Expanse, apparently based on them using a picture from that show re the commonality of someone being surrounded by blue & white dots.

At least the clickbaiters are getting mileage out of this...

It’s so dead it’s gotten a renewal for next year, the Short Treks are IN ADDITION TO, not replacements for, DSC, there are three other series underway with a planned fourth, all under the auspices of the co-creator of DSC—yep. Better call it now. Trek, time of death, 12:30 pm, EST, 8 March 2019.
