Did CBS Steal the Tardigrade Idea?

According to the creator of the games twitter, CBS treated him with disrespect and is now going to file a lawsuit against CBS.

Yeah good luck with that.

I tried to prevent this as much as possible but CBS treated me in disrespect. I am officially going to court against CBS' Star Trek Discovery http://anas-tronaut.blogspot.com/2018/08/tardigrades-case.html … #Tardigrades #StarTrek #gamedev #indiegame #indiegamedev #pixelart #adventuregames

If CBS feels he has any kind of case, they'll quietly settle it out of court.

Even if they don't they still might will because it will likely be cheaper then a lawsuit and honestly I think that is what he is counting on - for cbs not to want the expense of a lawsuit and give him some money to go away. Though I expect the "they disrespected me" comment is likely he already asked for money and got told no.

Will be interesting to see what happens but he better have a lawyer doing it pro bono or on contingency because legal fees will rack up fast.

I doubt that firm wants to hear the phase "Star Trek" again

I can't believe they took that case to begin with. Maybe they had a shot with a produced film and receipts? But, $1.4 million collected and nothing to show for it... I don't think Erin Ranahan actually thought things all the way though.

:guffaw:

Oh wait, that guy is serious?

If "disrespect" was legally actionable, every person on this planet would be in court for the rest of their lives.

He tried to have an open dialog directly with CBS but he feels that they are brushing him off, so now he is proceeding through legal channels.

This is like asking if Trump knew that Cohen was paying off Daniels.

That is:

  1. Sure, probably, maybe, certainly;
  2. Nothing will come of it.

I think this is simply a situation of two people having a similar idea at the same time because tardigrades had been in the news in relation to space travel. It is not a stretch that two people had a similar idea because of media coverage of tardigrades who became our very first interstellar species.

I honestly don't know what might or might not be true. From what I've seen, I'm not dismissing the likelihood that STD took ideas from this guy. I just don't think there's a way he can make a case here.

That is the problem. Tardigrades have been in the news. Is two people using the same thing that has been in the news independantly a stretch? Then when you read his complaint things like a "a guy couple where one is white and the other has a beard" are listed as real items.

This guy just wants money.

The guy has filed an official lawsuit. It is laughable but it is there. Gonna be interesting.

So can tardigrade vs CBS match CBS vs Axanar?

Oh wow, he's in Kuwait.

I don't think it's right to compare this to the Alec Peters case. This isn't a Star Trek project, or a ST fan. Moreover this isn't a case of someone trying to profit off of the ST IP. He was just making his own thing a few years ago, and had it protected under copywrite. Yeah, he's trying to get money... but that's sort of the point if you feel your property was taken, right?

That guy from France who made an ad, the style of which was then pretty blatantly used by Disney/Lucasfilm for "Solo" posters got his case settled quickly.
