CBS/Paramount sues to stop Axanar

Whoa. In a totally unrelated story I am right now listening to on the news:
The newscaster said something that for the first time I fully understood directly 'because' of the litigation discussions in This discussion thread. Quote: "But if he does sue then he will open 'himself' up in ***discovery***."


:lol: Okay, okay, I get that this will seem inconsequential to most readers here. :lol: And I can't remember a time when I was unaware that Discovery was part of Litigation, and that one lawering tactic in the tool box is 'bury' the other side In Discovery (thousands and thousands of documents in dozens and dozens of boxes to be burdensome or sometimes hide the one needed sliver of evidence the opponent is looking for in a misfile of said sliver of evidence without expressly and illegally withholding it). Though other than that my understanding of what it entailed has also been vague at best for as long as I can remember

But this time, when I heard those words, I had the fairly complete picture of what and why; if the person threatening the lawsuit actually follows through and sues, that same person risks little secrets of his own being laid out and admitted to..... in Discovery!

Anyway, it was pretty cool to me. :lol: :lol:

This guy hasn't got a clue. It's ridiculous one sided nonsense that attaches authority to one filing over another by a layman ignorant of litigation practice.

"Bombshells". What laughable nonsense. Even if they are successful in arguing that the studios have not produced everything, that doesn't mean they somehow have an advantage overall in the case as it doesn't mean that what allegedly hasn't been produced in any way helps their case even if it is revealed. What's more, the true "bombshell" in all of this is that they have effectively conceded the ownership of copyright contention, which means that their dispute is really now just about whether or not the material is an infringement. So basically they have to hope that in these supposedly missing documents there was an out and out concession by a studio executive or employer that what Axanar or other fan films were doing was fair use, the likelihood of which is pretty low.....and even if they did exist it doesn't automatically mean that the court will accept that such a comment negates the right of the studios to bring this action.

I think Lane should appreciate his ignorance of the litigation process before deciding what is and isn't a mini victory. He's just making himself look like a tool.

He clearly hasn't shut up going by the activity on Axanar's various social media platforms. Good ol' Alec. Still thinks the world is filled with plebs who can't see the obvious.

It was rather stupid writing, even by Mr. Lane's standards.

So presumably Alec is feeding this to the blogger, probably word for word, to get it out to the true believers. I guess he thinks that by spelling out the defense strategy in a public forum he's helping his team to win (?).
