Newly acquired core samples dating back some 2.1 million years suggest an early band of lost space travelers known as Axansis habilis inhabited the Southern Californian coastal area. After extensive excavation researchers recovered data crystals which chronicled their four hour history. Information gathered indicates their culture died out suddenly after they claimed the intellectual lifestyle of a native Ground Sloth trapped in the La Brea Tar Pits. No Records of transferred ownership has yet been discovered.

Its really beginning to look like C/P's insistence that Axanar is a professional effort is going to short-circuit a whole lot of the fan-film angle W&S have been pursuing. If the judge rules against W&S on matters relating to fan film discovery, it will be a big problem for Axanar.
CBS/Paramount isn't 'insisting' anything - the person who made that statement (and did so repeatedly) FOR OVER A FULL YEAR AGAIN AND AGAIN was Alec Peters himself. L&L are just pointing out to the Judge tat in light of this fact (which they can show numerous instances of) - Erin Ranahan's representation of the 'Axanar Works' as 'just another fan film' is disingenuous at best or an outright lie at worst.

Again, cases like these don't occur in a vacuum; and as long as L&L show the MULTIPLE TIMES over more than a year of Alec Peters referring the Axanar as "The first independent Star Trek feature length film..." along with "We have a professional cast/crew and run ourselves like a professional production company..."; the Judge is allowed to use common sense and say "Yes, it appears Alec Peters only started referring to his project as a 'fan film' AFTER the lawsuit was filed..."

Erin Ranahan keeps trying to maintain the 'fan film' characterization because she realizes full well, that if/when it's shown that was not the situation with regard to Axanar; she has NOTHING to use as a defense, and might as well just submit the case for Summary Judgement and call it a day.

Slightly off-topic, but as far, as i remember Of Gods and Men was referred to as "independent Star Trek film" long before Axanar existed by it's creators (and as recent as Renegades's latest crowdfunding effort this year), so no points for telling the truth for Alex here, either.
 
Good God............if Zavin doesn't put Ranahan in her place, then I'm sure the Judge certainly will (these guys strike me as ones who wouldn't fall for/buckle under the pressure of any of her shenanigans).

As far as LFIM goes, everything he continues to say and do will only serve to dig his hole that much deeper. With the 'Fair Use' defense all but dead in the water (I'm assuming C/P proving Trek ownership would sink this?), what plausible angle could W/S really take? That said, I'm going to enjoy reading/hearing/seeing all the stupid stuff he does/says as he gets more desperate.
 
They can lie and play word games all they want - the only people they are fooling are themselves. Some donors, the general public and most certainly L&L all know better

That's classic LFIM scam artistry right there. Deceiving his customers that want a refund in exchange for their personal information and trying to muzzle their 1st Amendment rights.

I hope someone gets their hands on that document sending notarized copies to the California Office of Consumer Affairs and the State Attorney General's Office. Oh, the fun they would have investigating LFIM. :biggrin:

Have you ever actually read the 1st Amendment? It doesn't apply here. Jumping on the Axanar hate bandwagon seems to be the "in" thing to do here sadly. While I do agree that Axanar went too far, the childish namecalling and now invoking of non-applicable "rights" that show up here in the thread so often is as surprising as it is disappointing. I wish more folks looked at the situation in the axamonitor style instead of defaulting to mudslinging that is just as childish as what they're criticizing from "axanerds" who support "LFIM".

I have read the 1st Amendment and LFIM's ridiculous "NDA" meant to intimidate and silence refund seekers. Have you? The 1st Amendment is always applicable as a fundamental right of every citizen to use freely as they choose. Sorry that doesn't agree with your (and LFIM's) censorship agenda.

You're just proving again that you haven't either read it or simply don't understand the words written there. Here's the quote from the Constitution:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

Please provide a link to where CONGRESS (or any part of the federal or state government) is prohibiting backers' freedom of speech in a voluntary contract between two private parties as that would be a new piece of information worthy of an Axamonitor update. Otherwise, your claims of " 1st amendment rights" being violated is just as ridiculous as my supposed "censorship agenda" that you're lumping me in with along with childish name calling.
 
Childish name calling? Perhaps you should stop and consider that fact that Alec earned the moniker 'LFIM' (Lord Foot In Mouth) by being the one who lowered the bar/standard of decorum single-handedly. No one around here was slinging mud his way until his erratic and abrasive behavior started ramping up and he (along with his surrogates) cast all cares aside.
