CBS/Paramount sues to stop Axanar

Seems like the Axalytes have turned, or are starting to turn on Terry......

To be fair, back when some of this came to light, I said that Mr. McIntosh was ethically and possible legally in the wrong for not leaving any and all data and software behind when he left Axanar. And if you read my posting history, you can readily see that I have been highly critical of most of what Axanar has done. I'm not one of the Axatards drinking that Kool-Aid.

Oh, I'm not condoning any of what Terry did one single bit - I'm more inclined to take his side RE: that snippet I posted rather than that of some Axalyte

I get why he should leave the data, but why software that he built? Unless he was being paid to develop it, it's his property. The data, of course, is Axanar's.
 
From what I understand, and I could be wrong, he wrote the software "under contract" for Axanar. It's not his.
 
He must not have been under contract. If he was than Alec wouldn't have been negotiating too buy Ares Digital, they would already have had terms. The quoted exchange makes it clear that both Alec and Terry know it and the data are Terry's and he's due compensation to turn it over.
 
Either way, at this point, what should it matter?? If Terry's still tied into this, that's his problem. I can't imagine at this point with Axanar in a legal vice and the fan film community pretty much decimated, that he would be so stupid as to try and shop that software around (but again, if he wants to do something stupid like that, by all means......). The more the issue of money comes up in proximity to him, the greater the likelihood of him getting burned somehow. He should just walk right now, release what he wants whenever and drop the whole issue of money (if he's truly 'seen the light', he should know it's pretty toxic anyhow)

yeah, Alec offering to buy, rather than enforcing a contract, that says that Terry has a rightful ownership of the software.

Alec should maybe get a lawyer to write up a contracts...

What I find interesting is Alec's belief that somehow the settlement with C/P (if there is one) will allow him to keep the studio he's acquired through use of the Star Trek IP. <--- That's probably a big sticking point; and I don't see C/P allowing that. But who knows.

Plus, Alec Peters "loaned" Axanar $22,000? Guess he got a big raise in salary this year. :wtf:

Terry says he was under no contract, and that he bore the cost for developing Ares Digital. So there's no "work for hire" arrangement in place compelling him to give Axanar any of his work. The raw data he worked with, of course, belongs to them, and they retain it; he agreed to delete any of their data from his servers, which he says he has.
 
Perhaps. But one would think that a lawyer (or a lawyer-by-training) could argue that McIntosh was part of the Axanar group (after all, he did sign a non-disclosure agreement, did he not) and did all the work in direct support of said Axanar project, so there was at least a verbal contract to work-for-hire. Something like this was covered in the ethics portion of the CompTIA Certification course I took a few years ago.

As to the purchase of the hardware, again the question is whether or not there was any promise of reimbursement. Remember that this was supposed to be a FAN FILM project, something of a hobby, that one could reasonably expect members of the crew to incur out-of-pocket costs. No other fan-film project is fully 100% funded by donations alone, and I suspect that IT guys in some of the other fan-film groups gave their time and hardware to the project.

I really want to go take a shower for saying this, but I still side with Axanar on this point (barring some sort of documentation proving a promise of payment / reimbursement).
 
All the money's gone? I'm surprised it lasted this long. I was quite interested in the quote attributed to Peters where he stated he'd loaned Axanar, what was it, £20,000? Loaned. Not 'used' to further his fanfilm and possibly complete it but 'loaned' with the intention of getting it back.

It's nice that he can put money into Axanar and expect to get it back because all those donors won't be getting anything back at all.
