BREAKING: Official Fan Film Guidelines Issued

Anyone keeping track of which projects have gone all-original? There is "Renegades" and "Dark Isolation" so far - any others?

Nope, that's it.

Is Dark Isolation going all-original? I thought they were just retooling with a new title and format, but I didn't have time to watch their entire 45-minute (!) announcement podcast, so I may have got that wrong.

A word from David Whitney, Producer of Raven.

The Raven website is back up. Even though the website url is still startrekraven.com, we've began to scrub the term "Star Trek" from all texts.

After going over the new CBS Fan Film guidelines for the twentieth time or so, and after hearing a CBS representative talk about the rules, we've decided to go back online.

We are going to try to conform our film, now called "Starfleet Studios Raven Part One" to the new rules, but I do have some small but not unimportant issues with the newly published guidelines.

The rules which pertain to direct copyright infringement and intellectual property will be adhered to.
The rules which do not directly support their copyright, and copyright law, will be ignored.
Specifically, the rules regarding length of film, compensating people for their work, whether actor or CGI programmers, costume usage, and perks to donors that do not include any reference to Star Trek or CBS. And finally, the use of a standard typeface font will be ignored. We will however not use a "Star Trek" looking font for our title page. And since we do not usually raise money through online fund-raisers, many of the points are moot. Removing "Star Trek" from the project also makes most of the rules moot as well.

I feel that if we adhere to the rules regarding copyright law, we will be within the law and CBS will have a hard time making a complaint in court should they decide to do so.

I'd like to thank CBS for making the guideline public, so we know what their law team and their licensing team are looking for.

The statements made here are mine, and can change tomorrow. I'd like to thank the RAVEN team for hanging in there.

From what I understood of that video they are going to produce one more Trek Isolation vignette which has already been filmed and are going to be involved some way in Starship Farragut’s final episode, ‘The Homecoming’. After that they are going to completely ‘reboot’ the series as ‘Dark Isolation’ with a brand new two part pilot episode with a whole new ship design and concept.
These kind of responses will be what ends fan films for everyone. CBS will figure that it isn't worth the headache.

what the F is wrong with these people, looking at their website and youTube account, I found it very hard to find any actual episodes, just some pics or short videos of younger women in Star Fleet uniforms, and admirals talking around desks.
 
If CBS objects the first action will be a phone call. If it persists then the next act would be a C&D order. Failing that then it becomes legal action.
 
Alec is sending people to Raven in support and telling everyone about them flauting about not following the rules..

given that their website makes more then clear they are aware of the rules, I dont know why they would not jump straight to C&D.

This kind of post, does make me worry (as mentioned above) that this kind of attitude is going to create alot of headaches and, alot of extra work for CBS/Paramount (for no reward) who will quickly just say no to all fan films
 
We posted our Lanclos episode shortly after the guidelines came out. I know the Exec made every effort to insure it was well within the new rules. Some of the removed posts almost seemed to express a serious disappointment that C/P didn't come by and remove it right away. It makes me wonder how much of it is people reading into the guidelines stuff that just isn't there and how many people really wish for true fan films to simply go away.

If anyone from CBS is looking on, here, I'd like to suggest that, if they feel the need to issue a C&D, they should simultaneously lodge a complaint with ICANN to dispute ownership of the domain that Raven is using. It pretty clearly contains their trademarked name Star Trek, being used for a purpose not protected by free speech rights. (By which I mean, I could presumably get StarTrekSucks.com to critique or complain about Star Trek - but I can't use it to create an alternate product, even a free one, using their trademark.)

(Again, I'm not a lawyer, advice is worth what you're paying me for it, yada yada. But, I *have* been involved in an ICANN domain dispute before....)
 
The same thing could have been accomplished without making a public statement.

Exactly. This is an example of someone looking for attention. Had they just made their production without ever bringing up that they intended the flaunt the guidelines not one person (including CBS) would have said anything. But they wanted to stand out from the herd and get noticed. I hope CBS rewards them.
 
The statement for the guidelines was fairly clear, do your best to follow them or play somewhere else.
