It was the dawn of the third age of Star Trek, ten years after the cancellation of Enterprise.

The Axanar project was a dream given form for those people too lazy to come up with their own. It's goal: to prevent another JJ pew-pew fest by creating a pew-pew fest. It's a port of call, a home away from home for hustlers, hustlers, hustlers and hustlers.

Extras directors and faux-Fulfillment Directors wrapped up in the worlds biggest green screen, all alone in the Californian sunshine.

It can be a dangerous place, particularly for those who dare to speak out against proceedings, but it's Alec Peters' last best hope for some sort of meaningful career. I mean, there was the volleyball thing but that was decades ago.

This is the story of the last of the fanfilms, the year is 2016, the name of the place is Aries, sorry, Valkyrie, I mean, INDUSTRY studios (this week anyway).

I just watched the new teaser, and that narration was ridiculously cheesy. The whole "The Federation Stands United" thing at the end cracked me up. It was basically just propaganda for Peters' supporters.
I thought they were removing all direct references to Star Trek in all of the promotional stuff?

Fan Film ? Where ? You don't mean "that thing that will never see the light of day" ?
That's no Fan Film, just some extra long trailer to get extra money from fools.
Also I had no idea IP law was that old, learn something new everyday, eh ?

The Mouse would of handed him his own rear back to him months ago, w/ interest no less.
Namely he would of had to pay Dis to get his own rear back in one piece.

I just got this picture in my mind with several Disney characters gathered around a Thanksgiving table with LFIM's rear as the centerpiece, maybe with an apple in his, uh ...mouth.
 
Well, we're hitting the discovery phase very soon, and that's not done pro-bono and has real costs that the 'other side' aren't going to be liable for. This will be the first point where Alec will have to pay real money to keep the case going... at that point, I think 'settlement' is off the table anyway, if it isn't already.
The case has technically been in discovery since the scheduling order came out on May 10. And its costliness is more likely than not to increase pressure for a settlement not decrease it.

The more incriminating evidence CBS/Paramount gather in discovery, the stronger their hand in forcing a settlement. It's most definitely not off the table.
 
What would happen if Axanar and Peters, despite the strong position that CBS/P patently have, decided that no way were they going to settle? Would we hear of that development through PACER, a press release from L&L or CBS/P, or even through Axanar or Peters posting through social media?

Doubtful. If there's no settlement the case proceeds per the schedule outlined by the Judge (and agreed to by the parties involved); and we get a Jury trial in January 2017.

The only hint you might see between now and the trial would be if one party or the other challenged the request for any evidence as part of the discovery process. That would require a hearing before a judge.

Otherwise, most of discovery takes place in private, and if the case is settled during that process, the public may never know what all was discovered. Many cases are settled during discovery because it eventually turns up evidence one of the parties feels seriously questions its likelihood to prevail in court.

The only way I know of that they could absolutely commit to not settling is if they can pay for everything in between. Maybe their attorneys will want the case enough to stake Axanar with credit and hope for being awarded costs at the end.

The little experience I have had with discovery showed it does have a little potential for public leakage. The questions and answers are filed to the other party not the court, but protests of insufficient responses can be filed with the court, which might involve filing the materials received, or some summary of it, for the points in question. I think if either side wants to broaden discovery, they have to file for it with the evidence justifying the request. Both sides have noted they intend to file for summary judgment after discovery, so material would appear at that time. Perhaps someone with solid knowledge can say what to expect in the record as the drawn out process proceeds.

There is always Old Faithful, yep. But perhaps there are penalties involved with leaking discovery.

CBS/Paramount have many means to shut down Axanar other than the lawsuit, I doubt highly that it's a surgical strike to benefit all the other fan film studios by only effecting Axanar.
Corporations are always buying and selling off properties so I'm just wondering if this is about the goings on at a higher level.
For about the last year Alibaba has been funding and accumulating a stake in Paramount. Sumner Redstone also has been in a power struggle to maintain control of CBS. Is it possible the Star Trek Franchise follows the Mission Impossible franchise into the production arm of the Chinese?
 
Funny, though, I vaguely recall people getting all pumped up about the trailer when it first came out. People bashing Axanar on its creative merits are in large part just doing it to vent their frustration with Alec, and I bet some of the same people had been excited about it before (hence some here having donated). The only thing I remember people really complaining about when Prelude came out was the "Queen Bitch" line.

I was willing to allow that with a great writer, and a cast that insisted on dumping most of the pewpew, they could accomplish something. That was before I was aware it was shaping up to be a potential raid on the Trek revenue stream.
