CBS should have sent them a C&D or at least a registered letter to warn them about proceeding etc.. Now, perhaps, CBS did communicate this to Alec in some official form, we don't know, or will probably ever know if that happened or not.

Together, they both put pressure on the studio to settle this case amicably so that their movie could premiere without every other news story between now and July (or January!) mentioning that Paramount and CBS were suing Star Trek fans.
