CBS/Paramount sues to stop Axanar

From your Lips to the Head Legal Eagle's ears...I just cannot feature him imagining this will end well. I think he should consider the fate of the Kelvin, and what happened when it went into the maw of the Narada...only, he should imagine that the "reality alternaty" is that, instead of the Narada, he is steering inexorably for the bottomless epiglottis of the USS CBS-Paramount (NCC IP1).

And they do have money in the 21st Century.

That's what he indicated at the time. He owed MGM over $300,000 according to the bankruptcy filing. Considering that he DID NOT pay for the props its hard to understand where those funds were spent.
Sushi. Carpet squares. Setting up a donor store to sell (sorry, it's merch in exchange for 'donations', which is called sales everywhere else on the planet) merch he doesn't have a license to make, order, and sell. Conventions. Leasehold on a studio. No, warehouse. No, studio. YUGE green screen.
 
RMB seems torn at times between keeping his head down and his loyalty to Lord Alec + the project he's spent so much time on
From what I've seen RMB has a metric tonne of memorabilia ensconsed as Ares Studio (look, they call it that so I'm calling it that) so if and when it happens this divorce is going to get messy. I can imagine young Robert arriving one morning to collect his gear only to find it sold off and gone via Propworx. Might even be a selling point; "Lot #47 Thor model, previously owned by Free Enterprise director Robert Meyer Burnett"

Actually he went bankrupt before Axanar. And other than rent and promotion, the company has few expenses (inventory costs nothing). Now he did shut down productions (BSG notably) so there would be some hard costs there, and some warehouse not studio space. And of course he PROPERLY paid himself. Still hard to understand.

At which point that is theft and the items should be returned or Burnett sues Alec

What do you mean he did shut down productions?
 
People have short memories. TrekUnited was brought down a decade ago, but a year or so later, people were back getting screwed out of FedCon USA.

That was all Tim B's actions back then. I own TU now (I also remember you were in the running to buy it back in 2010) . TU was never 'brought down' as it still exists today, not sure what you mean by that. Maybe you refer to the program of funding a fifth season of Enterprise in 2005, an idea that actually came from members here at TrekBBS. Maybe someday I will tell you the story from my POV. ;)
 
For everyone telling Alec to be quiet and let the lawsuit play out. You're thinking like someone who would want to win the lawsuit.

I don't think Alec cares about winning. He wants his facility, He wants his prop business, he wants the notoriety,. He will spend the rest of his life billing himself as the one fan film maker who was so good Hollywood was scared of him. He needs to keep talking and podcasting to keep that up.

He needs articles to keep coming out against him. Because that fuels his followers. The people with him right now are so entrenched that any articles against Axanar feel like they are against him. The more they're attacked the closer they pull together. At the end they'll donate a hundred thousand more for Alec's new production after he's publicly fought his good fight, and been persecuted a bit more.

And his lawyers allow this because they don't care about winning either. They want to be seen arguing this case, They want to be up against CBS, they want to be seen as a firm attacking IP holders and the more blogs Alec get this in the better this is for them
 
Speaking of articles and blogs - quick q, sushi fans - once this case is over, would there be an interest in more fandom legal blogging? I can't promise regular updates as I have to do my Capstone project this summer, but would there be an interest in stuff about, oh, I dunno, cosplay cases, the Batmobile case, etc.?

You are most likely correct. Alec can keep churning a small group of people by maintaining the narrative that he is one man standing firm against corporate bullies.

I would. I'm fascinated by IP and copyright cases.

You should look into the tangled mess that was Marvelman/Miracleman. It was fascinating.

I agree with all of this, except the Lawyer bit. Successful Law Firms like W&S are built on a reputation of winning. They wouldn't have taken this case, if they didn't think they could spin this into a win, and in an open and shut case like this, it's a settlement that lets Alec Peters Keep his shirt on his back.

If they lose, which, if this gets to trial, they will, it hurts their reputation, and runs counter to the very reason they took this case.
 
Legal blogs springing up from this like fertilized dandelions sound a bit like Aunt Marge hanging around too long because you liked her Bundt cake. Society can't seem to make up its mind about Shakespeare and lawyers.

That begs the question then as to whether or not W&S did any due dilligence before taking this case. It doesn't take a lawyer to see that what Alec & co. did was blatant and egregious and with that said, it would then stand to reason that the likelihood of C/P settling and just walking away would be slim to none.

High-powered plantiffs w/unlimited resources who won't roll over + numerous defendants who won't shut up and instead keep making incriminating statements online are making W&S's decision to come to the rescue here, decidedly unwise.

those look like toys, not props. Different customer base.

I so hope that CBS requests an audit of the Axanar books.
