CBS/Paramount sues to stop Axanar

Here's the thing about this whole mess: I for one would still like to see Axanar get made.

I would love it if there was an out-of-court settlement in which CBS allows someone to finish the project, but a couple/few of the key players currently involved may NOT continue with it. Bring in leadership who all have clean hands in the deal.
I doubt Alec or Rob would ever let go of the project, or turn it over to someone else even if it meant getting made and they could have no involvement what so ever.
 
A lot of armchair experts on greenscreens here...

^^^This greenscreen is the kind that makes VFX people wince, because the more uneven the green brightness and the more highlights and shadows there are the more work it is to pull a good clean matte because the green information gets lost in the highs and lows. Very likely some poor schmuck would have to hand correct parts of this mess.

The reason you might build a cyc like the Axanar people have is that it's smooth, so if you light it properly, it's even without hot spots or shadows. Easier to key the green out.

The former ILM facility now 32-Ten Studios has very large painted green and blue backdrops.

I don't have a problem with Peters finishing it. What I do have a problem with is anymore fundraising for Axanar. After raising $1.2 million dollars, they should have enough to make the movie.
 
Now this man may have changed his mind or something but his relationship is not as casual as indicated in the above quote.

Isn't it interesting that there was an understanding that acquiring the rights to something is, you know, a thing?

So why is it necessary for Mr. Gerrold's work, and not for the IP owned by CBS and/or Paramount? Could Axa be, I don't know, cherry picking their behaviors based upon convenience, cost, emotion, the time of day, or any other positive that suits them?

But but but .... doesn't CBS spend more than that on a TV episode, and Paramount spends tens and tens of millions on a movie. How can you say "they have enough"?? :wah:


I'm kidding, of course, because I totally agree with you (on the money).

And they claim to have made their own license for the Ares ship models they are selling in the Donor Store. Because it seems licenses are a thing, too.

Great blow-by-blow and analysis of the second motion. Although, I snickered when I read this part (emphasis mine):

The ears are just a part of the aggregate whole. It would be quite the stretch to confuse Spock, T’Pol, Tuvok, T’Pring, Sarek, and Valeris with Count Dracula, Legolas Greenleaf, Jacob Black, Tinkerbell, or Nosferatu. Or Count Chocula, for that matter.

What I find fascinating about this defense — the "I didn't know any better" gambit aside — is that they're arguing that ideas, names and concepts can't be copyrighted. Yes, that's true. But it's the presentation that can be. And as you point out, taken as a whole — Vulcans, Klingons, triangular ribbons, etc. — there is clearly some IP infringement going on.

You can't copyright computers, or men wearing dark coats, or computer code, or the colour green, or virtual reality, or the concept of AI. So The Matrix is now public domain.
Wizards? Schools? Bad guys being resurrected? Magic? Nothing original there. Public domain.
