CBS/Paramount sues to stop Axanar

Guys, let's not speculate about Dianna. The picture that Tom saw could means anything. I just saw it. Looks like a selfie between friends. She's basically a fan-film maker much like Alec Peters is with his Star Trek fan-film until the lawsuit. :biggrin:
 
Well, I imagine they wouldn't have taken this case pro bono if they didn't feel they could win, AND felt that they could burnish the firm's image in the process.

Depends. I'm taking a case to the (English) Court of Appeal at the moment pro bono. I think that while it has merit it's going to be very difficult to win due to the current approach of the courts on the issues it involves. I'm doing it mainly to give my client a fighting chance and get my firm's name in the law reports, and that's always beneficial for getting new work.

At the end of the day two cases are the same, and have varying degrees of strength. A case can have legal merit but still be an uphill struggle. Conversely you can have a case you think is really strong and you get a bad judge who takes a dump all over it. Some cases have multiple arguments, some of which are string and some of which aren't. If I had to speculate I'd say that they think they have an argument/s to advance that they consider has at least some level of merit. Probably no more and no less. Given the significant time involved in litigation of this nature, you can bet that raising their profile is a not insignificant part in them taking the case on.
 
Who is to say. In any case, a few times in this thread I have called for much of crew to get out of Axanar, in fear they may incriminate themselves if they are listed as one of the 20 Does. Not sure if this is related to Dianna, but I would hope she (and others) remove themselves from this toxic situation. Alec is the captain of the ship, and he should be the only one that has to go down with it not any of the crew.

Depends how you look at it. If they choose to stay in spite of the litigation and Axanar is found to be infringing the IP, then the crew are helping to further that. That is surely their personal choice and not that of Peters?

True, but sometimes cults are hard to break out of, without a little external help. ;)
 
A question comes to mind based on what was mentioned in that FOX report.

When their motion was filed on Monday, was anyone from their defense team actually in a courtroom filing their motion, or is that done electronically, with a preliminary hearing date to be set?
 
I am also actively uncomfortable with talking about third parties (staff, etc.) personal motives and especially about personal relationships and the like.

Re the lawsuit, I wonder whether the argument that the studio prove their copyright ownership in detail will survive. Clearly it is a straw bale in the jet engine tactic, and down the road allows the defense to undermine the case by attacking the trail of ownership itself if ownership is allowed to be examined and questioned. It seems to me every copyright defendant would try the same tactic if they could. There must be precedent to keep this manageable.
 
Same, but I liked Star Trek 2009 because it was a fun action movie, I couldn't reater it lly see it as being Star Trek.

I saw it after it hit Red Box, I was expecting it to be horrible, so once again my low standards save me disappointment
 
Was just on FB, looks like Alec has a new girlfriend, wonder what happened with Dianna? He likes blondes, that's for sure. (not that there is anything wrong with that ;))

Personally, I'd be surprised if it did. The copyright for all of Trek is jointly own by the two studios. I think even a layman can see that the likelihood is that the IP will be found to be theirs.

That is unless Axanar's legal team are going to try and assert that somehow the IP belongs to the original writers, designers, etc (which is highly unlikely).
 
EDIT: Re: Diana & Alec: Never mind. I agree, speculating without any facts to go on is not helpful. Still, the meme was th efirst thing I thought of when I saw Tom's initial post on the subject.

Not a big deal, just curious if Dianna still is working for Axanar Productions if her and Alec broke up.

Chuckle. "Control the narrative." I imagine that the 500 people who actually care about this whole thing aren't going to be swayed by press releases, and if AP and Co. is hoping for a jury trial, they are truly delusional.

If this isn't settled, it WILL be a jury trial. CBS/Paramount requested it.

It's filed electronically, although this specific judge has also requested hard copies by lunchtime the next day of filing.
 
I noticed that the script (this time?) was written with Bill Hunt. I don't see any pro writing credits. Is he just a fan Peters found?
