You're kidding, in the Hollywood Reporter? In front of *entertainment* industry people, protesting that his dream is unfairly being torn down?
Peters is seriously lacking in soft skills.

Meh. THR isn't exactly the pinnacle of journalism, but being one of the top three industry trades regardless, Peters is really doing himself no favors by being so reactive and combative in those comments.
Years ago, someone on IMDb gave Sandy Collora some shit about the World's Finest trailer or Batman: Dead End (I can't remember which) and he took it extremely badly, much as Peters is here. Another poster (not me) came in and just offered this one remark which I never forgot: "Take it like a man, Sandy!"
In that spirit, I'll borrow the phrase. Take it like a man, Alec!
All that said ... having read through the comments, it is absolutely hilarious seeing Alec persist throughout as if everyone doesn't already know he's Alec Peters.

I don't see any reason why a judge, especially a conservative one like Klausner, would rule in that fashion.

No, the Paramount/CBS are prepping for the hearing on 3/21. Also, remember this Judge has a LOT of experience in the field. The Axanar response of course is going to read like: "it's so unfair, Paramount/CBS didn't tell in minute detail who has rights to what; or exactly in the same detail what we're infringing on; and the 21 minute piece we did make is a Parody and covered under fair use; and aside from a 3 minute scene; we haven't produced anything else <--- So given ALL that we don't think CBS/Paramount has a valid claim."
Thing is: Copyright DOES cover 'look and feel' and many other aspects. I seriously doubt the case will be dismissed. What will probably happen is discovery will be granted to BOTH sides; and on the basis of that discovery (which could take months or longer) Paramount/CBS will have to present specific claims on whatever (if any <-- and just saying that be be neutral) infringement they find; and present those to the Judge (with supporting evidence) to be ruled on (and Axanar's legal team will of course try explain why each claim isn't actually infringement, etc.) <--- This is what may take months /years, and I'm sure W&S strategy is to drag it out as long as they can in the hopes CBS/Paramount will come to them and say - "Okay, let's do a settlement..."
Time will tell if that strategy will work; but if the case isn't dismissed; I'm pretty sure Paramount/CBS are in this for the long haul. Settling will not be good for their Star Trek licensing business (and that's VERY important to them with a new film, the 50th Anniversary merchandise, and a new series) others will go - "Why pay? These Axanar guys didn't and they came away with <whatever the settlement allows>..." <--- And this is why I think Paramount/CBS will not back down or make a settlement - they want to make a statement with this case of: "You use our Star Trek IP to gain financially without a License, and we take you for everything you have as much as we can within the bounds of the law..." It's why they didn't bother with a C&D; they're going for the throat.
