CBS/Paramount sues to stop Axanar

maybe the showed CBS the script and got optioned. If so, more power to them, their thesis is proved.

You do know Dwain Esper opening every conversation with 'I'll sue' was considered odd even for show business, right? It's not CBS/Paramount's SOP.

No, that's interesting to read about, thanks. are you suggesting they might go this route? I was positing what I consider about the most unlikely possibile outcome for the 'tease' details.

Alec says some kind of paper work has been completed that he's very happy with.

New curtains are being installed at Ares Studios and they got new toilet seats, the kind that warm up!

Oh, right.

To answer your question: There is a chance that CBS may have picked up Axanar's script. Just like there's a chance that a snowball could grow legs, and walk unscathed through the Seventh Circle of Hell.

No offense to the designer, but that's bland and obvious. It's an iPhone4 TOS communicator; look at the band around it.
Speaking as the designer, the similarities to the iPhone are definitely there. (But the reverse-callbacks to cell phones seem appropriate given the historical relationship the TOS communicator and cell phones have had) All that being said, the design is actually based around the concept of sleeking up the "Wrath of Khan" communicator, because it's a good start for a more primitive TOS communicator. But it obviously had to be sleeked up a bit because it looks ridiculous. Sleek up the Wrath of Khan communicator, and it's basically an iPhone with a lid. To put it more into the TOS realm, I added a "much more TOS-style lid" (as per the design comment on the approved version). The final version is still quite chunky, though.

I thought they bought a walk in humidor for smoking victory cigars.

Also, new communicator? With a lawsuit pending?
The communicator tweet is from June

Well, I despised the TWOK walkie-talkie communicators so it's unsurprising that I'm not keen on something influenced by them. Both the pilot and series communicators were tapered shapes, not blocks, and I think that gives them some style.

Hmmmm. Today will, in theory, be the first time we hear a truly official word from Axanar about this lawsuit. According to our resident lawyers, they're required to answer the court's complaint against them or face default judgement.

I'm sure we all have a few predictions of how this will go down.

here's hoping you and other creative folk contributing to this are not burned by any mistakes at the IP level of the project.
Almost all of the contributing artists (all but Tobias Richter, I believe) have done so on a 100% volunteer basis. Since the rhetoric of the complaint seems to target those who "vicariously infringed" (those that received a direct financial benefit), it would be a stretch to drag the artists into it.

thats honestly good to hear, and I hope it pans out that way.

Remember my prediction Alece will be back in the prop business after this? Right from the start, he seemed most perturbed by my Propworx remarks. I had only posted a few posts IIRC before he banned me. He handled me all wrong. If he had appealed to me instead of attacking me, or just ignored me, I probably would not have devoted so much time to it. Seriously cut back on my Farmville crops. :D Once he banned me, there was no longer anything to stop me from telling the truth about him.

Don and I heard from a forum member today: "... you’re both mentioned by name, this is what Alec posted in his forum today:"

“You know, the haters, lead by my cbyerstalker and Internet bully Don Hildebrand, have made a lot of wild claims about Propworx. So let me set the record straight.

Propworx has never screwed a customer. EVER. Sure, you will get customers who are not happy about something, and we certainly make our fair share of mistakes, but we have always made every problem right. ALWAYS.

So while Don and Lyn can go on about how evil we at Propworx (and in particular me) are, they cannot point to one single customer who has ever been screwed by Propworx.

And as to our 2012 bankruptcy filing? Well, again, not one single customer lost a dime. Basically it was almost entirely MGM we owed. While we are disappointed we couldn't fulfill our obligations, that is business. You live and learn. And considering that MGM had just come out of a $5 Billion bankruptcy themselves, well, Don Hildebrand rants are rather ignorant and laughable trying to make them sound like a victim. I don't hear him saying anything about the hundreds of thousands of MGM stock holders who lost billions in the MGM bankruptcy. Does he advocate not watching MGM movies now? Does he advocate not driving GM or Chrysler cars since they went through bankruptcy? Bankruptcy proceedings are a part of business sometimes.

Oh, and I do think the # 1 Republican contender for President has had FOUR bankruptcies, and we consider him one of the countries best businessman (though I certainly don't want him for President!).

So the next time some insane hater rants about me and Propworx, ignore them. We have facts on our side and hundreds of very happy customers. And most of them are on this forum.

Alec”

Submitted for your consideration by Lyn, an "insane hater". Now that he has thrown down the challenge, time to start compiling complaints re Propworx, and there were lots of them. From overpriced shipping, to ridiculous delays in shipping, to incomplete hero costumes from BSG being completed with generic items, to shill bidding (he admits bidding but since he is a collector, it is not shill bidding) and way more. Don, you must know half a dozen off the top of your head.

Ah, the wonders of insomnia...

  • I would consider MGM a client of Propworx by my understanding of the context, which is close enough to customer for me. I guess it's true, though, they didn't lose a dime -- they lost 3,000,000 of them if the numbers I've heard are correct.
  • Oh, but it was only MGM, it must be okay!
  • Not being able to fulfill your obligations "is business"? No. Just no.
  • They did it, so it's okay if we do it! Hmmmm, that sounds familiar...
Sigh.

When the shit hit the fan, they were claiming it was them seeing the script which prompted the lawsuit (although I imagine the Axanar Annual Report had more to do with it)

Which they want to believe was because CBS felt threatened by the high quality of it. As in, "My God! That is the real 'Star Trek'. It will expose our phony product. We must suppress it or it will take over the market." When, if CBS did indeed see the script and that indeed prompted the lawsuit, it was probably because the people reading it went through six boxes of highlighters underlining all the IP violations in it.

I really like the design you came up with; looks like a nice step between the ENT and TOS communicators but slightly bigger, more robust for a time of war. What I imagine is a small screen is a good touch too as any re-imagining of a flip communicator to me should include one.

Looking forward to Pacific 201; not a backer, slipped past me while it was open, but love your work both on that project and what I know to be yours from Axanar.
