CBS/Paramount sues to stop Axanar

Brilliant.

So when I type "axanarcoffee.com" into my address bar, I get a page that says the shop is currently unavailable. If I go to any of the other pages directly, they're still available and the links on them lead back to the home page.

So, you're right. For all intents and purposes, it's still there.

I'm just going to be over here shaking my head in amazement.

"http://axanarcoffee.com" leads to an unavailable shopify site. "http://www.axanarcoffee.com" leads to the current site. This may have always been the case.

'tis true.

Interesting link below from the Hansa side. Whether it's genuine or still active is another matter.

Peters was a member here for some time, so I went digging in the old Axanar thread. Let me tell you -- it's almost comical now, seeing how he refers to himself in the third person here. If I can find this shit, you can bet your bottome quatloo CBS and its lawyers will too.

That is a man who believes his own hype.

Wow, so I just caught up. This is awful. Am I justified in fearing that Axanar could mess it up for every other fan film out there?

I have the feeling that NV/P2 and STC are probably OK, as slavishly making new episodes of a 50-year old show probably doesn't compete with CBS interests (i.e. nobody is going to confuse it with the original show, nor will people not buy BR/DVDs of the original show because they think the new productions are True Trek(TM)). I think the main thing that could potentially get them in trouble at this point would be if they were trying to merchandise stuff (although I suppose they could resell officially licensed merchandise made by others and use the proceeds for funding additional productions - since CBS would be getting their "cut" in that case).

Forgive me if this has already been discussed in the thread somewhere...but if a film festival, or any other public forum shows Prelude at this point, would that film festival be in danger of getting some sort of legal notice?

Incredible. So let me see if I've got this straight.

So what we've got here, folks, is a nice-looking, professionally-designed e-commerce website (I shrunk the zoom level to make more of the USS Ares visible; the gray bar with the buying controls on it would normally be bottom-aligned on the browser screen). I see a Klingon dressed in a uniform that is a near-copy of what General Chang wore in Star Trek VI, a starship that looks like a near-clone of a Klingon Battlecruiser, and another starship that looks like a kissing cousin of the Starship Enterprise. Coffee is for sale on this e-commerce site--hell, they even take Diner's Club and JCB!

I also see that the site is

Not CBS. Not Paramount. Axanar Coffee.

If this isn't a blatant, open-and-shut, rampant misappropriation of the intellectual property of CBS and/or Paramount for a for-profit enterprise (pun unintended), I don't know what is.

Shut up! All fan films sell coffee!!

Okay. I see no Trademarks or Copyrights called out on the specific Axanar Coffee pages other than Copyright © 2016, Axanar Coffee. As CBS doesn't have a Trademark on Axanar so they can probably get away with that as you can't Copyright a word.
What about the depicted imagery and wording on the bags of coffee?

I suggest you misread. I am simply saying the pages are absent any ™ © or ® marks. EDITED TO INCLUDE FROM MY PREVIOUS POST: other than Copyright © 2016, Axanar Coffee

To be fair there are also no Trademarked brandnames on any of the items, albeit the Axanar logo could conceivably be seen as impinging on the ® starfleet delta/flying-A logo.

The © status of the elements in the images is also not indicated, but they are certainly using images from © works.

Hahaha. One of the Axanar Marines schools me about copyright on Reddit:

Oh yeah, the marines are busy over at Reddit. Hell, one of the moderators must be a big supporter of the show because even though my account is three years old (though I only have about 20 posts as I visit Reddit infrequently), I'm "the very definition of a shill account."

Paranoia much?

It DOES have a © mark - at the bottom
Exactly, Copyright © 2016, Axanar Coffee. Are the images and product description part of Alec's claim of copyright?

I'm really surprised that they haven't shown up here yet.

Yeah, I had that happen when I was "Speaking" with those 'Marines'. I love how they always go to the "Your a shrill if you disagree with me".

And I thought the more vocal Star Wars fans were bad.
