CBS/Paramount sues to stop Axanar

So... will we also find out that Peters in fact did buy a car with the proceeds from the Axanar fundraisers after all?

So apparently if you're not with Axanar you're part of the "Fighting Chairborne". Seems a little petty to deride dissenting fans with that sort of language. With the highly respected position Gerrold holds with fandom, I think it speaks volumes about his interests with Peters & Co that he's willing to stick his good reputation on the line for them and create division among fans.

I think he's been found out.

He bought a car?

I seem to recall there being a lot of talk among online members and critics of this entire enterprise (sorry) and denial last year from various members of the production about whether Peters had purchased a new car and if it had been done so using Kickstarter funds.

Allegedly, Peters had sold his own car and "took a break from his career" to help fund the launching of Axanar back in 2012/2013. Rob Burnett vehemently denied this allegation though, and many of the Axanar faithful came back later to point out how it was a badge of honor for Peters' personal fandom to have sold his old beater of a car to make the film. (I guess Peters literally sacrificed for his fans sins?)

We were assured many times over each time this came up and in the most serious way that this was in fact not the case. Given the recent turn of events, I am understandably curious about it again.

I find it funny it says nothing of funding the film....... Just the film makers.
That could just be a poor language error - and isn't the real concern the proportion of the proceeds that don't go Peters way are ending up in the pockets of commercial third parties - third parties who would not be getting that money without trading on the Trek brand name?

Maybe the successful "young entrepreneur of the year" gets the bus into work. ;)

If Peters should at this point pull the plug on Axanar, dismantle the sets, pull the plug on the studio, shut down his company, refund the backers as far as is possible to the point that Axanar doesn't exist anymore, and cannot be easily restarted, would ParaCBS still have a lawsuit? Would the trailer and Prelude be enough for them to continue, or would they be back at square one when it comes to setting a precedent for fan films?

Yes - the infringement has already occurred.

Take the four minute prelude and trailer together - CBS want $150,000 per infringement.

You have got:

* ships (federation)
* Klingons (Klingon)
* uniforms
* Vulcans
* Klingons
* Garth
* Soval
* Robert April

That is off the top of my head - each is a seperate infringement...

Would the trailer and Prelude be enough for them to continue, or would they be back at square one when it comes to setting a precedent for fan films?
Well, technically there would still be a copyright breach, but realistically it would make the litigation no longer worth pursuing financially as the overall objective of it, to stop the production, would have been achieved. While it is useful to use such proceedings to set precedents, if the defendant entirely or mostly remedies the claim then I suspect the court would take a dim view of any party still trying to push it to trial. Certainly would where I'm from anyhow.
 
plus from his actions it seems he is ready to ride this baby all the way into the ground. I really hope that over the weekend he got some real professionals that haven't drank the Kool-Aid to give him some good advice that he WILL ACTUALLY follow. I doubt it but I hate to see anyone go down as hard as he might. :cardie:

I dunno. As has been pointed out numerous times, damages aren't always the issue with Copyright cases, so even if Axanar returned every unspent penny, they STILL exploited CBS and Paramount's Copyrighted property. And let's got forget they made and released Prelude, using money raised off said I.P.

I have a feeling he's not the type to listen, such is his hubris. The Propworx saga ad bankruptcy would seem to suggest as much.

Wonder if they would go on a spending spree..........so when it's done they can say..........sorry it's all gone. You know on defense----Not MY fault....blame CBS. :rolleyes:
