CBS/Paramount sues to stop Axanar

I haven't seen what comments Peters made exactly, but I do have how all of this might have played out if he had been more cooperative. Obviously CBS is fine with fan films in general, so it would seem to me that Peters himself is the cause of all of the drama, and if he had behaved differently this might not have ended up turning into such a fiasco. The fact that he keeps making posts about continuing production alone could be a bad idea. If somebody is threatening to shut you down, it could be seen as taunting them when you keep talking about how excited you are about the business.

I expected delay after delay, while other projects took priority, because, and the true believers would keep contributing, and nothing would ever get done except for more fundraisers and more salaries and more sushi.

That would be the Moller Skycar formula.

I think the difference is the actors. You can't keep actors on board indefinitely, and once the actors drop off, investors (er, donors) would be pissed off, as that was a big factor in them donating. Sure, Alec would remain as Garth, but nobody cares about that.

Even worse than those two (IMHO) is David Gerrold, who should know better, even if this is a benign comment. Here's what he had to say about this incident:

But I agree with you on Gerrold. He's become one of these Trek pundit's who makes his contribution to the franchise much more than it really is. And continues to speak as if he's the end all authority on STAR TREK.

I used to respect Gerrold a lot more than I do now. Not as much these days; mainly cause of the attitude that you mentioned, I find a lot of his opinionated stuff short sighted or needlessly antagonistic.

I meet Gerrold a few years ago at WonderCon. He was nice enough and we had a long chat about his writing, journalism and other things. But he's trying to out Ellison Harlan Ellison nowadays.

And to be honest, his work has never resonated with me. I've read the STAR WOLF books and they're entertaining, but hardly memorable. I will say, however, Blood and Fire is the best of them. Too bad the NEW VOYAGES version wasn't as good.

I also found the Star Wolf ultimately forgettable. And Blood and Fire, while a interesting concept, I think its production was hampered by ego. Gerrold wanted it made as a Trek script and by god he was going to get it made as a Trek script. And honestly, interesting is not the same as entertaining; and what was revolutionary or groundbreaking 3 or 4 decades ago is not so much these days.

More importantly, faced with the threat of a full trial his conduct is totally contrary to his supposed desire to work with the studio, especially with an application for injunctive relief pending.

I don't know what the court's view or powers are on costs in California, but over here in the UK a court has the discretion to penalise a party on costs over where conduct is concerned (be it a reduction on costs claim if the party with poor conduct is successful, or unassessed indemnity costs in other situations). It would have been sensible for Peters to halt production pending the outcome of the, at the very least, the application for an injunction, if not the trial itself. By pressing ahead he's potentially making things even more difficult for himself and sending out a message of non-cooperation to the studio and the court. Still, it would certainly be consistent with his widely reported narcissism and hubris.

I'm a writer myself, and if I could be as abrasive as Harlan Ellison, I'd consider myself as having finally made it!

Joking aside, I like David Gerrold, too. I still have my copy of The Trouble with Tribbles, where he described the process behind the episode. I like his sense of humor. I do think he's wrong here, though, and that he most assuredly has a dog in the fight.
