CBS/Paramount sues to stop Axanar

This is a train wreck in progress... A slow train wreck... Is it right ? Is it wrong ?
Is it fair ? Is it unfair ? What is gained by being nice ? What is lost by not being nice ?
When the folks who are driving the train are saying "We will win" when the writing is on the wall says "End of the line" and the train is still moving forward, what do you say ?
The fact is this guy has done this sort of thing before and got slapped by a lawsuit, and here he is again caught red handed w/ his hand in the cookie jar, what can we say ?
Should we say, oh we are sorry you got caught a second time doing this ?
If someone who committed the same crime twice be forgiven ?
This whole thing has spun out of control before it even started, yet everyone has to suddenly play nice now just because ?
Most here have been trying to just wrap our heads around this whole mess, dealing with it by being humorous, saying silly things, trying to make light of the whole situation.
The facts still remain, the head honcho has a history of getting into trouble and getting slapped w/ a lawsuit, and here he is getting slapped with another one, we are now to trust him ?
What is the point of putting our trust in someone who has broken the law in the same way before ?
I ask you, heck I ask everyone, what's the point ?

There is no fan reaction (in any significant sense) - nobody gives a shit In a way (financial) that they can measure.

I think you are way downplaying the amount of negative PR that this could potentially generate. This is the price that CBS/Paramount felt they were willing to pay to deal with the issue.

Nothing will be solved on a BBS or a Facebook Group. I think Axanar is dead but no outcome would really surprise me. From complete destruction of the project to Alec and Robert being EPs of the new 2017 TV show..........it IS Hollywood. :mallory: Strange bedfellows.

Not so. Such things are wishful prophesy that can only be determined in retrospect or by the privvy. By "wishful prophesy" I mean that by enough people saying so, it becomes true. If they had said it will turn out well, it might. That's how people and politics work; they head exactly in the direction that they are looking, and they try to convince others of going there too to ensure their vindication.

Yes so. Again, this isn't a simple "Cease & Desist," this is a civil lawsuit. It's not "have my secretary send them a form letter," it's "call in our legal team, this is serious." To take this step, they'll have made certain that all of their bases were covered. THAT is why Axanar is in trouble, and it's why I think Axanar received a C&D, and they ignored it. I could be wrong, but CBS is engaging in a lawsuit, and has filed an injunction. Those are big, heavy steps.
 
I'm not a lawyer but from my understanding, Fan films operate in a legally gray area, like a house of cards, and anyone stirring the pot might cause it all to come crashing down.

I guess the best policy is for other fan productions to wait and see what the scope is, but it also might be a good idea for them to consult their lawyers and to prepare to publicly chime in to distance themselves from this sinking ship, so that any notion that they're all in the same boat and share the same practices can be dissuaded.

I guess they'll have Peters to thank for not only the additional legal expenses but if fan films get shut down over this, I'm sure there will be a lot more people ready to show their appreciation.
 
Serious for a moment - If the Injunction actually happens, then what ?

Are we to turn a blind eye to that and say "We're so sorry, Uncle Albert ?"

If I was a fanfilm production right now, I'd put the brakes on production, and lay low till this all blew over and hope that my production was outside the impact zone.

I suspect when the truth comes out they'll be a reveal of several calls, emails, and letters telling them to stop a lot further back than two or three months ago.

Because I suggested much earlier in the thread that CBS should ask the court to give them possession of the project, let the fans complete it, then show it on All Access as the first of a special series of fan projects. Respondents didn't believe CBS would be so gracious and mentioned union issues. I thought it would be a good consequence of the Axanar project overstepping it bounds, with CBS making some money from it on All Access (and not this Alec guy, if he is found to have abused the property after all evidence is presented). CBS PR wins (maybe), Axanar itself wins, the volunteers and Kickstarter contributors win, the fans win (if they pay CBS their $6 for All Access), and whoever deserves to lose, loses.
 
I have been away all day playing with 100 ton diesel locomotives (oh what fun that is!) and so have had to do a rapid read through of posts made today. Can somebody tell me the answers to

A) If Star Trek Continues is Anti Axanar, why did they offer the use of their sets?

B) Can somebody tell me what has happened with Wang and why he has left the production? Mr Todd's reasons are now a matter of public record, but Wang seems fairly quiet about it

If the injunction happens, Axanar loses the ability to raise money, sell merchandise, pay anyone, or work on the project itself. At that point, we could all be the most optimistic people in the world, and it won't matter.

Agreed. CBS made their displeasure well known back in August with an article about Axanar from The Wrap:

"CBS has not authorized, sanctioned or licensed this project in any way, and this has been communicated to those involved,” a representative from the network told TheWrap. “We continue to object to professional commercial ventures trading off our property rights and are considering further options to protect these rights."

Alec Peters made the claim everything was fine, that CBS didn't tell him anything. I think we're about to find out how false a statement that was.

Ridiculous idea, because that would encourage other people to make I.P. violating content in hopes of profiting (e.g. notoriety, visibility, etc.) in the same manner. No, they have the slam Axanar's fingers in the door here as a warning to others who might toe or cross the line.

Agreed. As I mentioned before (somewhere), look what Axanar did without CBS approval. Think what would happen if they gave them room to maneuver!
 
Truth, we are in the dark, everything is happening behind the scenes.

However, the public face Alac Peters is putting on this whole thing is less then stellar.

Let's not put to fine a point on it, the guy has come across as an egomanic who won't shut his trap to save his own skin & will take down his little empire along with him, a take no prisoners type attitude, which does not look good in the public eye.
