CBS/Paramount sues to stop Axanar

I think I'll make a bunch of red baseball caps that read "Make Star Trek Great Again!" and sell them at Axanar rallies.
 
It's a business venture between Peters and the coffee sellers. Whichever way you look at it the coffee is sold using the Star Trek brand name. That's trading on the goodwill of someone else's IP.

Oh, I agree. I'm just thinking that's separate from this lawsuit.

I'd be willing to bet if/when CBS finds out about the coffee, they'd probably reach out to the coffee seller and tell them to remove all of the names/images related to Trek...and if the coffee guy is defiant, threaten him with legal action, then he'd likely take it down if it gets that far.

I doubt this coffee seller, and most people for that matter, have the foolish gall that the Axanar leadership has to stand in defiance against a major television network all the way to court.

If Peters'/Burnett's current attitudes are any indication, I'm convinced that's the only reason this lawsuit is taking place - Axanar has been beyond uncooperative. They've been outright defiant.
It's not separate. The pleading states that Axanar Productions have claimed entitlement to use the brand and claims compensation in respect of any profits made through it's use.

Personally I'm not convinced by what Peter and Burnett are saying. I find it very hard to believe that they were not on the receiving end of any correspondence prior to the commencement of proceedings, that this was the first they heard of it. A major studio, with an in house legal team, and thereafter an independent law firm instructed, but nobody at any point has been notified of studio concerns? I must say I find that a little hard to believe. Usually there will be at least some attempt to resolve a dispute prior to litigation because litigation is so expensive.

I find it astonishing that he and Peters are continuing to solicit donations in spite of the proceedings. That's pure idiocy.
 
I agree entirely. Peters and Burnett can scream to high heaven, but they themselves are their own worst enemies in this.

I see rumors about recent meetings with CBS and Axanar... but all I can find is that August posting...

I have a hard time believing that CBS did this without first sending a C&D.. *IF* Peters and company received one, would they have said anything about it? Maybe Paramount/CBS think's their case is just that strong, maybe they feel the infringement is so grotesque that it could not be rectified with just a few simple changes and just want to stamp the mess out now.

Unless the court orders otherwise all proceedings can be attended by the public.

I'm hoping it's streamed online somewhere, I'd love an excuse to make some popcorn & watch the insanity unfold for all to see.

It'll be fun to see them try to worm their way out of the hole they dug for themselves.
