Michigan woman sues over misleading 'Drive' trailer:

The lawsuit filed by Sarah Deming says distributor FilmDistrict marketed "Drive" as "very similar to the 'Fast and the Furious,' or similar, series of movies"

The actual film "bore very little similarity to a chase, or race action film ... having very little driving in the motion picture," the suit alleges.

Deming's lawsuit goes on to say that the film "substantially contained extreme gratuitous dehumanizing racism directed at members of the Jewish faith, and thereby promoted criminal violence against members of the Jewish faith."

She is seeking a refund of her ticket price, and intends to turn the case into a class action suit to end misleading movie trailers​

Oh, for the love of...

It will be interesting to see how far this nonsense makes it through the court system.
 
Common sense: The word "very" Is subjective in the contexts used in both the alleged marketing quote and the suit. The allegation should be deemed unprovable.

1.) So the trailer was different from the movie? Well, if this goes far in the court system, I'm going to sue George Lucas over The Phantom Menace. ;)

2.) "It had little driving in it." You have got to be kidding me! :lol:

3.) It contains "extreme gratuitous dehumanizing racism." Well, by that logic, we should get the miniseries Roots pulled from the shelves. It had numerous instances of the N-word in it, after all.

I can sorta see her point though. It's not honest for a film company to promote their film as something simply to get people in to the cinema to see it, and then give them a film that is not at all what they expected. Almost qualifies as false advertising.

given that the studios have been doing it for years I'm surprised some-one hasn't tried it before but can't really seeing it flying when all she can claim for is the cost of her ticket (what $10 in the U.S?)

That's probably the reason for going for a class-action suit. Turning a lot of small damages into one big damage gets things rolling.

Years, more like decades. In my neck of the woods it costs $10 for a movie ticket. It costs $20 to file a law suit(without hiring a lawyer and such). So, it would cost more to sue someone for the cost of the ticket. You would actually lose money by suing, what a dipshit.(not you, the lady)
 
Bitch should have read some reviews before going. They all mentioned how misleading the trailers was.
 
I'm going to sue over FRIDAY THE 13TH PART IV....The Final Chapter my ass. They made SEVEN more Jason flicks after that.

^ Here's some actual one-star reviews of The Neverending Story from Amazon. I really hope these people were joking. :p

How dare they call this the Neverending Story! I mean it ended right. Isn't that called false advertising. I am very dissapointed, I was expecting to have a continous on going story. The title mislead me from the start. Ok so they marde part 2 but where are the rest of the parts. If it truly is the Neverending story then there should be an infinite number of parts, coming out at regular intervals. I give this 1 star since they won't let me give a 0, for false advertising and for misleading the public.
Neverending story my azz. It's over in an hour and a half.
When I first heard of this movie I knew I had to go out and buy it. I wondered all the way home from the store, "How did they fit an infinitely long movie on one dvd." When I got home and actually watched the movie, I was shocked. It took nowhere near an infinite amount of time to watch it. If they call it never ending, it really shouldn't ever end. I just heard they have a sequel out, so I'm going out to buy it tomorrow. Maybe they realized their mistake on the second one. I'll know soon enough.
This movie is complete trash. First off, IT ENDS!!!!! How can a "neverending story" END?!?!?!?!?! People aren't stupid you know! A movie can't claim to go on forever and then come to a conclusion. Second, what does Bastion yell out the window at the end? I know it is "supposed" to be the name he gives to the child-like empress, but WHAT IS IT? For all the times I've watched it, I still cannot understand what he is yelling. What pisses me off the most about the scene is that the people who closed-captioned it for television and video couldn't even understand it!!!!! I MEAN FOR CRYING OUT LOUD!!!!! Isn't it kind of necessary to understand the name he gives her? Did the people who made the movie just decide "Well, we can't think of a name for the child-like empress so why don't we just have him scream incomprehensibly?"

I first saw this movie when I was a little kid and let me tell you something. It scared the HELL out of me!!!!! If the movie is going to be marketed as a kid's movie, make it enjoyable for kids and not something that gives them nightmares. Kids movies should be light and funny, not dark and forbodding.

Let me say just one more thing. As terrible as this movie was, the other two are even WORSE!!!!! Please, in the name of all that is holy and sacred in this world, as well as for the sake of your own sanity, stay away from these movies.

In that light, it's not a bad idea; we should never have come to expect regular, blatant false advertizing from movie studios. If they were in another business, they would be in serious trouble. For some reason, though, entertainment huckstering is generally exempted when requiring honesty. I wonder why. Entertainment really isn't important, but it's not particularly gratifying to have to sort through the lies.
 
Seriously, is there some kind of contractual obligation that trailers give you a fair, balanced and comprehensive representation of a movie?
 
No, but it's false advertising, which is illegal outside of entertainment. That it's a hassle to the audience is almost beside the point. The more I think about it, the curiouser it seems.

To be fair, there are many different ways to learn about a movie's content besides the trailer, so I'm not sure how much impact a misleading trailer really has.
 
I feel the same about 'Brokeback mountain' - I went to see it thinking it was about cowboys, those guys were goat herders! I left quickly so didn't see what adventures they had.
