As a believer that it's 'when' and not 'if' my own personal opinion is that Brooks won't come back just to retread being a Star Fleet officer and put the uniform back on. I think it'll see him on the peripheral of what we remember from DS9 with Star Fleet only having limited involvement with cameos from, hopefully, Michael Dorn and Alex Siddig etc.
If Sisko shares the existence of the Prophets, i.e. non-corporeal and beyond time, maybe he's back already. Or, maybe he never completely left. Watching your dad as he blackens his first redfish as a kid? Walking behind your great granddaughter as she takes her first steps? Watching the Bajoran solar system form? All easy enough when you're timeless.

That's what happens when you turn down promotion. Picard was offered a RADM berth (academy commandant) before Sisko even made commander.
I don't see Sisko being that snotty about it.
Picard: "Admiral Sisko"
Sisko: "Captain Picard, nice to see you again. I'd like the Enterprise to join the port wing of Task Force 61."

Yes. It would be like caring about your standing in the high school cliques when you're in graduate school.
It becomes hard to believe you ever cared about that.
From the viewpoint of Sisko, I think it would depend on what he wanted to achieve by returning to corporeal form, and resuming his role as a Starfleet officer might not be his top priority.
From the viewpoint of Starfleet, it might depend on how they would regard his sudden departure. If they considered his final confrontation with Dukat and his subsequent extended stay with those wormhole aliens unauthorised by them, they might consider it desertion and strip him of his rank (granted, that's the worst case scenario, and unlikely since he would be a war hero, but not impossible either. Starfleet never was too fond of his divided loyalties in his dual Starfleet officer/Emissary role to begin with.).

Surely given a body was never found and no witnesses were present, he's listed as MIA?
Well, Kasidy knew he was going to the fire caves because he told her so before he went. She also got this vision of him where he told him he had to stay with the Prophets. So it would depend on how much she told Starfleet (and to what extent they would believe her).
