a couple of notes.
in where no man has gone before some of the mitchell and spock have known each other for years survives in this line from dehner.

I know those from your planet aren't suppose to have feelings like we do, Mister Spock, but to talk that way about a man you've worked next to for years is worse than

i actually would have liked to have seen something more similar to what the draft was for mitchells death.
but instead of his letting go of kirk's hand because he is too weak to hold on to it ;gary lets go in horror of what he has done and what he may do if he reverts again.

Really neat site, Sir Rhosis! It's fascinating to read about these early scripts. How do you get hold of them?

One note about your "Court-martial" review -- it says at one point:

Much has been said, rightly, about the lunacy of allowing an old girlfriend to prosecute Kirk. Any lawyer, worth any salt, would have immediately recused herself.

This was an issue that came up when I was doing research for my upcoming novel The Buried Age, which depicts the similar situation (based on "The Measure of a Man") wherein Picard's lover Phillipa Louvois prosecuted him for the loss of the Stargazer. I was told by a couple of military vets that it's different in military cases than civilian ones, because military prosecutors are still officers subject to the chain of command. If you're given an order to serve as prosecutor in a given case, then you have to carry out that order to the best of your ability regardless of your personal feelings, or else you could be charged with dereliction of duty. So recusals based on personal relationships don't apply. (Another analogy, also from "Measure of a Man," would be Riker being ordered to prosecute Data.)

I also downloaded the entire US Manual for Courts Martial as part of my research, and there's nothing in it that I can find about disqualifying trial counsel based on past personal relationship with the accused. Regulation R.C.M. 502(d)(4) states that a person can be disqualified as trial counsel (prosecutor) if that person is the accuser, an investigating officer, a military judge, or a member of the court-martial panel, but it doesn't say anything about relationships with the accused.

there is the simple practical matter of time and distance.
i always had a feeling that it played a part in both of these cases.

you may not be able to bring in qualified prosecutor but that is some interesting piece of research christopher.

Many thanks for the compliments. I write these for those of you out there who enjoy reading about original stories and drafts. I've been intrigued by some of the brief mentions of early drafts since I purchased Asherman's "Concordance" back in '81.

Christopher, you are no doubt correct. Honestly, my statement was not based upon any legal knowledge, just something I had "always heard."

The majority of the first season scripts were purchased a few years ago from Roddenberry dot com. Most of the outlines and second/third season stuff were purchased from ebay. In fact, the seller is quite a prolific poster here at the TrekBBS, but I'm worried that naming him might be construed as using the board for business, etc. If anybody wants to know, pm me, and I'll set you up with him.
