Read carefully - McG says he intends to use the themes, "clearing up confusion over early reporting of Elfman's involvement"
IE: the MTV thing from Elfman was the early, confused reporting.
Which makes me calm down a lot over Elfman.
If McG is mandating use of the themes... OMG. I'm gonna go nuts! With joy! That makes me so happy!

Some directors have all the luck. No matter how bad Raimi goes, he'll still be welcomed with a Spidey-4. McG, not so much. He is having to prove with hard determination that he is the best man for this movie. Only after the release and public reaction will it tell whether he was the best choice or not. All pre-release signs point to 'yes'.
I have a feeling Terminator Salvation is going to be quite good, and I'm going to be glad that I've been defending McG all along.
The jury's still out on whether the movie will be good, though I too think it's going to be "quite good", but at least McG is treating the franchise with respect and being as careful as he can with established Terminator canon. Going out of his way to get Linda Hamilton seems like a step in the right direction.
The trailer looks ghastly to me, but watching the movie will tell the tale.
As to McG vs. Elfman---the producers may have been given power to select the composer. If McG himself is a producer then that's a given. But the director does not always have to power to make these decisions. That's why doubledipping DVD releases with the director's cut is so common. Remember the stories about directors shooting enormous amounts of footage so that a movie can be carved out by the editors? Remember the stories about diva stars overruling directors? How can people so consistently assume the director is always the producer as well?
And, how can the second unit directors be so insignificant is the director is the man with the artistic vision?

I guess it depends on the situation, but I think you're giving a bit too much power to the producers. I think when it comes to the creative side, the director usually has final say, unless he gets veteoed by the studio (in this instance). The point at hand -- the inclusion of a theme in a musical score -- falls under the purview of the director. While I have never had to work with a studio or governing production company before, in my experience as a director (albeit limited), it is the director's job to dictate and give direction on where the score goes musically, which involves informing the approach for how it should sound, and in my experience, the more detailed, the better the direction.
Then again perhaps in this case, McG does not have final say... Even though he specifically mentions his desire and creative intent on including the theme. I am inclined to believe him.
That's not what the composer was saying in interviews. Doesn't mean that it's wrong, of course.
If you could do that, it'd be appreciated. Finding interviews saying that it wasn't a legal issue is easy; the other, not so much.
