Chinese pop signers fined $12,000 for lip-synching

I never thought I'd say this about China, but: GOOD FOR THEM! :techman:

Lip-synching is a pimple on the face of music. Whoever bans it is OK in my book. If I had one. :lol:
 
I'd call it a stretch to pin this on Totalitarism but it's certainly indicative of discouraging misleading performances and lying to the audience. The fine was definitely excessive but then this China, they'll execute you for less so I'd call it "lenient" as far as crimes there go.
 
While I don't agree with the practice of lipsyncing, such disputes should be settled in civilian, not criminal court.

Well you could sort of argue that it's a form of fraud.

There was a lot anger in Australia over the recent Britney Spears concert where it was pretty obvious that she was lipping synching.

Now if you're paying over $100 a ticket (before travel and accomodation) and the singing on the stage can't even sing live you'd been feeling a tad ripped off.

Some fans tried to justifiy it saying they were there to see the singing and the dancing (though from some of the comments and news reports the dancing wasn't much better).

Though I guess the real leason is not go to concerts but talentless hacks who can't sing without processing and who's dancer moves are very generic.
 
Even if it is fraud, that is still a civilian court case. I very much doubt that there were any guarantees on the tickets bought that it would be a 100% live performance.

This is why I've never gotten the appeal of going to a pop concert. I like some pop music just fine, but I just don't get it.

I go to rock concerts, 200+ to give you an idea. I want to see a Rock/Metal band give a show. Not Britney go through a wardrobe change every 3 minutes while she lipsyncs to her album.
 
There's a whole lot more than lip-synching going on in American Pop concerts. They don't even play the instruments anymore. Heck, they don't even pretend to play them. That's why the kids who are highly critical want to see awesome dance moves, because you can't fake that!

You know what stuck out to me? These people make you get a performance license in order to write and sing.

I seriously hoped I'd made that up for my Cardassians in Sigils and Unions--but damn! They actually DO that?! Lemme tell you, if a nation is as repressive as the Cardassian Union, that is NOT a good sign.

If we can't ban lipsynching, we should at least make it mandatory that it be pointed out ahead of time. "THIS CONCERT WILL BE LIP SYNCHED" or something like that.

That still does not make it a matter for criminal court, but for civilian court. People buy tickets for a performance and that does not necessarily mean singing, but has a very fluid definition.

If you think that it is fraud, let me point to a very famous example of fraud that went to civilian courts: the lawsuit against tobacco companies for their fraud was in civilian court, not criminal court.

I don't think a law would ever be passed to that effect. However, as TheBrew pointed out, I do think it would be possible (in my personal, non-lawyerish opinion) to sue in civil court and win damages. Misrepresentation of the product might be one thing to sue under...another possibility MIGHT be breach of contract (failure to deliver on goods and services paid for--the transaction to buy the ticket being an implied contract). But I do think that's more appropriately a civil matter as opposed to a criminal one.

(Oh, and remember that in civil court, the standard of evidence is "preponderance of the evidence," not "beyond the shadow of a doubt" as it is in criminal court. You might stand a better chance of actually winning damages in civil court, and hitting 'em where it hurts--in the pocketbook. ;) )
