Tardigrade lawsuit appealed

    I read the whole thing, though I had to go back and forth many times to get the gist of what they were attempting to claim.

    They are not Copyright Lawyers, that is exceptionally obvious.
    They haven't got a clue how to formulate their arguments for this kind of suit.
    That document is very hodgepodge.

    It kinda looks like after a cursory Google search, they just grabbed some case sample chit off the Internets that seemed appropriate and went with that.
    If I am remembering correctly, I think that some of it even appeared in the lawsuit documents that the CBS lawyer filed with the Court as a rebuttal to Abdin's original claims.

    That section with the pictures, to me, just seems to prove exactly what the original Judge described in the dismissal.
    They look similar, but previous case law says that one can't copyright a characters sex and/or racial features.

    And trying to claim that CBS admitted to any wrongdoing, didn't work the first time.

    Why isn't selling Tardigrade patches and billing twice for postage?

    That surely would be a major boost for lawyers fund.

    Also the part in your quote where it says the steam page contains media with the tardigrade. While that is technically true, as it's part of the game's logo, the steam page itself doesn't contain any media that depicts the tardigrade interacting with humans or moving FTL. It doesn't even have that July 2017 trailer on it.

    These waters are out of their element. I still think they took this expecting to file some papers and cbs just agreeing to settle so it Woukd go away. I don’t think they had any thoughts they’d actually have to argue the case and certainly not to the appeals court.

    Ripper needs a spin-off called Judge Ripper. 'You're in the Courtroom of Judge Ripper Sheindlin. The cases are real, the people are real, the verdict is DEATH' (or a community corrections if you have mushrooms)
