    Just when we thought it was over .... anas Abdin has officially filed an appeal of his lawsuit over the Tardigrade game.

    no info yet on what grounds he is using to appeal on.

    *sigh* so much for accepting the judges ruling.

    I am surprised because it seems a waste of time and money with little basis for an appeal.
    However there is already a go fund me to work on the money side.

    I’m going to be interested to see the grounds for appeal. “I don’t like the verdict “ isn’t good enough. Needs to be an issue of law.

    though evidently he plans to hire network engineers and a marketing firm as part of this

    As no further evidence can be introduced in appellate court, this will be likely open and shut fairly quickly.

    you do make a good point and it is what makes his gofundme perplexing. He’s wanting to pay network professionals which I can only assume is to try to somehow prove cbs saw his steam stuff. Even IF they could find that info and even IF they acquired it in a legal manner that would be admissible he simply can’t present it to an appeals court.

    hes also wanting a pr and marketing firm. Again the court doesn’t care.

    this is all nerdritic and me wanting to make cbs look bad and they don’t really care about anas Abdin at all. He’s a means to push their agenda. Nothing more.

    The case was dismissed, wasn’t it? The judge gave every opportunity for him to come up with something of evidence and he wasn’t able to. The defendants honestly didn’t do that much to get the case dismissed. It ended up being what many of us suggested right away: there was no substantial similarity, which is the keystone of an infringement case. The court just took its time. But there was no trial. No settlement. No long drawn out discovery period. No depositions. There was barely any early motion practice. Just a lot of administrative details. The court of public opinion, however, was far more complicated.

    I’d like to say that it amazes me that anyone, both Abdin and the donors, would buy into this bullshit. But then again it’s obvious that people will believe anything. Exhibit A: Axanar.

    what I meant was when you don’t pass the first mtd then it basically is an open and shit case since it means even when looked at it light most favorable to the plaintiff they still can’t win.

    So initial case was open and shut. I expect this one will be too.

    I can't believe that there's a lawyer who would take the case on.

    Unless his original one is hoping that the Go-Fund-Me will pay him.

    Doesn't Abdin have to pay the court fees from the previous try?

    I just had a thought, was the case dismissed without prejudice?

    If not, he doesn't get a second try...

    "...Cases dismissed “with prejudice” usually can't be reopened. A judge will only reopen a dismissal with prejudice case under very narrow, specific circumstances. Cases dismissedwithout prejudice,” on the other hand, can typically be reopened for any reason..."
