In a way, they did. They lost and are still losing in the court of public opinion. I've said this before: CBS/Paramount needed to come out with a strong public statement explaining why they took the stand they did with Axanar, and why Axanar is different from all other fan-film projects.

True, but they did have an epic WARHAMMER 40K battle there.

Axanar may sound intriguing on its own website, but actual facts prove otherwise. Check out AxaMonitor.com.

No. The only people that know or care are a tiny fraction of people who actually care about fan films. If they comment it just sheds light on LFIM. If anyone still stands with Axanar they deserve to loose their money.

So in the meantime, Axanar minions go around and tell people "Did you know CBS sued Trek fans?" completely unchallanged??? This is a typlical case of CBS listening to the lawyers and not the public affairs experts. Pretty dumb move, if you ask me.

    Uh.

Fandom is a niche market. Trek fans are a niche in that niche. Fan films are a niche in a niche in a niche. Axanar is barely a niche in a niche in a niche in a niche. Not even a pimple on the ass of the entertainment industry.

So what if Axafans go around saying, "Did you know CBS sued Trek fans?" I'll bet the response from the average Joe is, "Ok, bye now."

    Or, "SECURITY!" :techman:

Yeah, I've heard more of the story now. And I'm frankly relieved, because now I know that as long as people use common sense with their fan creations they likely will not get sued.

I disagree, and the IO9 article tends to support my case.

My favorite response to the "CBS sued the fans" comment is, "No. CBS sued one fan — the one who tried to make money off of Star Trek, took fans' money to make a movie then never produced it. But spent all their money."

That's the point. Axa-hats talk to fan sites and even main-stream media (Newsweek, for example), tell all the "inaccurate" side of the story, and CBS does nothing -- NOTHING -- to correct the record. As you said, only niche-fans have a clue what fan-films are, so the rest of the readers take it on "face value" that CBS is the Bad Guy here. You and I know the truth, but we're not paid to spread the word. CBS has a whole department whose job it is to counter bad press, so why aren't they doing so????

Maybe not, if they had to stoop low enough to bother with the "CBS SUES ITS FANS" story. But they did, and CBS chose to not comment due to "pending litigation", once again showing the lawyers were running their PR policy.
