Ralph McQuarrie has passed away.

They are clearly based on Fremens so why not?

That's kind of stretching things, isn't it? All we know from the movie is that the Sand People are a vicious group of people that live in the desert. They like to beat teenagers up and raid their cars, and are scared off by an old man flailing his arms while making some noise. Not really very Fremen like at all.

Or does the EU make the claim that Sand People outfits work similar to Stillsuits?

The thing hanging under their chins has been identified as a water catcher since the 1970's. Once again, it's an homage, having been inspired by it, not "stealing from". Wanna mention the "sandworm" skeleton too?

Frank Herbert filled a lwasuit against Lucas for "stealing his stuff".

Damn! You got us! I mean there's no way to check to see if that's true or not. I mean, it's not like there's a vast resource of information at our very fingertips for finding the answers to questions.

So, the #1 Google answer for if Frank Herbert filled a lawsuit against Lucas? Survey says!!! ...........

Ooohhhhhhh!!! Sorry, but seems it's not true.

Further research through Google, utilizing proper spelling of "filed" and specifying George Lucas reveals this site. Halfway through the page, in a section titled "Dune & Star Wars" discusses the similarities between the two with mention that Frank Herbert had indeed considered taking legal action against George Lucas, but ultimately didn't. The relevant paragraph:

The similarities are more common with the early drafts of Star Wars' script. Princess Leia is transporting a crate of spice instead of station plans, the Jedi are identified as Jedi Bindu and the galaxy is divided into great houses. Herbert decided not to sue Star Wars creator George Lucas because the court battle would have gone on for years, making it more costly and troublesome than it was worth.

^ Maybe he did, but then again if I counted all the bogus quotes I'd seen attributed to Einstein, Franklin, and Thomas Jefferson on the net over the years...

If it's just one site or two I'd take it with a grain of salt.

I've never quite understood how much you can use of another story before being culpable. Even if Lucas has used Dune as a starting point, I don't think Star Wars really plays like Dune but I don't know what the boundaries are when it comes to legal action.

The similarities between Arrakis and Tatooine are obvious.

Dune wasn't invented out of thin air, either: See the John Carter books, various Flash Gordon strips and The Seven Pillars of Wisdom by T. E. Lawrence ("of Arabia").
